No. This is clearly a case of premeditation. He sat at the top of the street for a good bit of time before he drove into the crowd. I wouldn't take his case for any amount of money. There is no attorney who could win this.

Some Twitter journalists already saying rumors cops think the guy was scared and not malicious.
They will have to prove he went there to kill people, no?

If they were thinking that, then they wouldn't have charged the man in question with second degree murder. That charge requires malice and aforethought, though not premeditation. If it had been unintentional, he would have gotten charged with vehicular manslaughter.

The rumors came out well after his arrest.
Again, just because someone is charged with something doesn't mean they have prosecutable evidence for that specific charge.
He may very well have a bunch of condemning shite in his history and it'll come out, but I won't be surprised to see him downgraded to multiple manslaughter charges.
