But it was instituted as the 'way the Senate should operate' by patriotic founders.
Same way the Declaration of Independence doesn't have force of law either. But it forms a very big statement of "who we are."

If you are going to filibuster, then by god occupy the floor and speak.
I would definitely like to get rid of the faux-filibuster. That is certainly not within the way the filibuster was supposed to work. That does just institute a 60 vote rule.
The only way I actually support the filibuster is to physically get your arse up there and occupy the floor. If you don't have enough support to continue that occupancy, then you are too fringe to get in the way of stopping things for more than a day or so.

Could? I think it's pretty well agreed upon that if the Democrats ever regain power, they will put forth their own set of draconian laws that will make regaining power from them, near impossible. Hell, they are already trying to impeach Trump based on zero evidence other than "he's mean and hurts my feelings". The left is already radioactive.

And I am convinced that they will, using the excuse that since we did it for SCOTUS that they are justified in doing so, despite the fact that the filibuster was not originally meant to be used for appointments , just legislation

Did you see the decision by the Supreme Court in Austria that overturned the conviction of the Muslim that raped a 10 year old little boy in a public bathroom at a public pool?
The conviction was overturned because the prosecution did not establish that the rapist was aware that the little boy did not consent
(Rapist did get convicted again in 2nd trial, but the decision to overturn was still absolutely disgusting)
THAT type of lunacy is what we were facing if Hillary had been able to replace Scalia, RBG would likely have retired & she had a shot to replace Kennedy & Thomas as well
