“The federal government has made it far too easy for government agencies to take and profit from the property of those who have not been convicted of a crime,” Paul’s statement read. “The FAIR Act will protect Americans’ Fifth Amendment rights from being infringed upon by ensuring that government agencies no longer profit from taking the property of U.S. citizens without due process.”

Some have observed that if implemented, this legislation could be the most significant reform in decades. Heritage Foundation policy analyst Jason Snead writes at The Hill, “The bill, if passed, would be the most sweeping reform of abuse-prone federal civil forfeiture law since the 1980s.”
quote:
Back then, Congress turned to civil forfeiture laws to empower law enforcement authorities to seize and forfeit the ill-gotten gains of drug kingpins, criminal organizations, and money launderers, as well as the property they used to commit their crimes. To encourage the use of this newly enhanced tool, Congress created the Assets Forfeiture Fund and allowed federal law enforcement agencies to keep the proceeds of successful forfeitures. The result? An exponential increase in forfeiture activities. In 1985, the first year the fund existed, it brought in just $27 million. In 2012, the value of forfeited assets was $4.3 billion. Today, more than 400 federal laws authorize the seizure of cash, cars, and homes for a range of alleged offenses, and allow forfeiture proceeds to be divided with state and local agencies through Equitable Sharing programs administered by the Treasury and Justice Departments.

Nope, I don't see how this bill errodes civil liberties, pays off government employees, or makes congressmen rich, so it's DOA.

Disagree.
If Law Encroachment loses the incentive to grab your car and anything else connected to you through the stop the LESS likely to be pulled over.
Forfeiture means a single stem, seed, improperly labeled aspirin, that vehicle is now property of the cops.

I am glad to see Rand doing this. I think he has the President's ear and will be pushing harder on important matters as we move forward.

Lol at thinking reforming a federal law passed by Congress is somehow an example of big govt working.
Literally trying to fix a problem they caused.

What's the compelling argument for keeping Civil Asset Forfeiture laws as is? I can't think of one.

But golden nugget told me that I needed to get over myself for supporting Rand.

The only CAF that I'm ok with is the taking of weapons/money/property used in connection with gang/drug activity AFTER a conviction and after due process to determine if the items to be sized are in fact connected to the unlawful activity.

Right. Which I why I asked for a compelling argument for keeping them "as is." I think it's fair to confiscate money and property gained through convicted illegal activity. I just can't think of an argument for keeping a law that punishes people who are still considered innocent under the law.

Anyone who doesn't vote for this is either corrupt to the core or seriously misguided, ignorant and naive.
Sad thing is Trump will likely veto it if it makes it that far so hopefully they can get a veto proof majority with a majority of the democrats and enough republicans.

I like it. That is some good sense legislation.

Actually it should be after a conviction and ALL legal appeals in court are exhausted and there is no doubt at all about the defendant's guilt.
