They'd find out with a background check.

There is government at work for you. It will now cost more money to hire an individual than previously because people are afraid they are going to hurt someones feelings.

Can they still run a credit check? That will tell you an awful lot about a person. Of course, I ain't talking about people that aren't old enough to have established one.

A good resume check certainly can't be unlawful.

What if the company is based out of state and all applications go to company headquarters for preliminary review?

The law does not prevent companies from conducting background checks once they have made a conditional job offer to a finalist. But it eliminates a standardized checkbox question about previous run-ins w

So hr newbs get to waste their time conducting interviews to weed out the candidate's that won't meet their hiring standards. Waste of money but a nice break from the filing room for them.

Meanwhile, not a single felon will be hired that wouldn't have gotten the job before this process.

Do a background check and then toss their resume.

The felony label on people should be removed once their sentence is paid if their crime was nonviolent.
The Enron guys will love getting back into business!

Couldn't get much more non violent than that.

Wrong. Someone will get the job, someone won't, regardless of laws like this. If a previous criminal now gets a job over another person, that other person is now out of a job. So it's net 0.

Illegal. Background checks can be run only after a conditional offer of employment.

sorry for linking this loathesome website

People use Archive.is to link articles without giving the websites additional clicks. I don't know how to use it, but it seems like a good idea.

So a former bank robber can apply for the job of bank teller and no one can check his/her background to discover that little nugget?

What kinds of felons would you be okay with at your business?

If I'm in sales, drug dealers.
If I'm in security, thieves.
If I'm in IT, hackers.

But now you will probably get:

If I'm in sales, hackers
If I'm in security, thieves
If I'm in IT, drug dealers

Because you won't have any idea what they did.

You can ask the question, you just can't do it at the outset.

For the Louisiana residents in here, y'all do realize that Louisiana has a form of "ban the box" legislation, right?

Yes after you have made a conditional offer. Then it is probably like firing someone to rescind the offer and now you are paying restitution. Have fun with that.

Currently only applies to unclassified State employee positions.
