Just if you ask me to guess what happened, my years of being on this earth lead me to believe guys who take their shirts off arent usually the ones looking to break up a fight
ETA: I also dont think the shirtles person really matters too much in this whole thing. It sounds like Hayes brandished his gun first which just about wipes off any chance at self defense. He is likely toast now

I'm guessing that's what the defense is getting at...not that getting hit 4 times justifies the shooting.

Just had a thought, was it ever said Smith was driving? Did anyone say or claim that?
I know most people are assuming that but I can't recall it ever being stated as fact.

Because she felt she had to diffuse Will? I can't think of a better reason.
I'm just imagining Will and Cardell as they approach each other. If Cardell starts the aggression isn't her first move to stay in the car with other woman and call the cops? If Will starts the aggression, that seems the most likely scenario for her exiting, in an attempt to calm him.
Someone mentioned in the Nola comments about battered woman syndrome and her trying to protect Will by taking a bullet for him.

Considering it seems like Cardell came out of his car with a gun, maybe she decided that she should try to keep the situation from escalating?

In the 911 call, Hayes can be heard telling an off-duty police officer that Hayes had to shoot Smith because Smith was in the process of retrieving his gun from his vehicle. The off-duty police officer also testified that he heard Smith claiming that he was going to get his gun.
“Oh, you have a gun? I have one too, I can play that way!” Christopher McGaw testified as to what he heard Smith say. Smith reportedly had a blood-alcohol content 0f 0.24 percent at the time of his death, three times the legal limit.
While a skilled lawyer may still be able to sell a jury on the notion that Hayes was indeed acting in self-defense, the fact that Smith didn’t have his gun and hadn’t even emerged from the vehicle with the weapon will make it harder.
The presiding judge declined to reduce Hayes’ $1.75 million bond and set a trial date for September 20.

I have no doubt Will Smith had a bunch of drinks considering he was at FQF and several restaurants/bars.
I'm saying he literally didn't blow. He wasn't BAL tested prior to his death. The only way I know of to determine BAL level after death is by testing urine in the bladder.
I question the accuracy of that method.

Please post a link to this urine method of which you speak. Given that we are talking BLOOD alcohol concentration, I don't see how they would use URINE to derive that number. I am a doctor but not a toxicologist, so please enlighten me.

False positive up to 0.20. Not that it matters. He was murdered.

What people keep forgetting is that Hayes chased, and rear ended Smith before getting out of his car with a gun.
If someone did that to you, you woudl assume they were going to kill or seriously injure you.
Its going to be hard to sell self defense when the guy is unarmed and you engaged the situation, gun in hand.

Do a search to see how BAL or BAC is obtained from a dead person.
