FCC Plans to Fine AT&T $100 Million Over Capping of Unlimited Plans

"Unlimited Means Unlimited"

The Federal Communications Commission plans to fine AT&T Inc. $100 million for allegedly deceiving consumers about unlimited wireless data plans, the agency said Wednesday.
The FCC alleges that AT&T sold consumers data plans advertised as unlimited, then capped data speeds for those customers after they used a set amount of data within a billing cycle. The FCC says those capped speeds were much slower than the normal network speeds advertised by AT&T, and that they impaired consumers’ ability to access the Internet or use applications for the rest of their billing cycle.
An AT&T spokesman said the company plans on “vigorously disputing the FCC’s assertions.” The spokesman said the FCC previously identified the practice as a legitimate and reasonable way to manage its network to benefit all customers.

“Consumers deserve to get what they pay for,” FCC Chairman Tom Wheeler said in a statement. “Broadband providers must be up front and transparent about the services they provide. The FCC will not stand idly by while consumers are deceived by misleading marketing materials and insufficient disclosure.”

This is the largest proposed fine in FCC history, according to a senior FCC official. The official said AT&T made billions of dollars off the practice.

AT&T can go frick themselves. They did this to me one month, I almost blew up the store. This is welcoming news.

I like Steven Levy's take on it:

Once again @FCC refuses to label fraud and theft of services by carrier as criminal.

And where and how is ATT gonna re-up for this financial loss?
Oh yeah....

This must make it A-OK! Right?

No, but he has a point. If they go up to a ridiculous amount for data, I'm switching carriers. Should have done that in the first place.

that may be tough for you dispute since you used to send out texts to unlimited users pretty much telling them you were going to throttle them, assholes.

Me keeping my unlimited data plan is the ONLY reason im still with at&t to this day.
If at&t forces me to give up my data plan for a 2-yr upgrade priced phone, im switching carriers in a heartbeat.
my service quality has gone far far down recently, while folks with Verizon around me are blazing circles.

I think the defense is the following...not that they didn't do it.

I got one for the first time yesterday as well

I am grandfathered into my unlimited with AT&T and when they pulled that throttling shite I knew it was illegal. They never throttled me but used to send me warnings all the time.
I hope they choke on every cent.

Every time I have altered my account over the years, I do it on chat support and make them type that my change will not take away my grandfathered unlimited. I then screenshot it and tell them that I just screenshot it.

I am for punishing the company who lied to their customers, but why is the penalty being paid out to the government agency instead of the customers?

Verizon already did that to me. We're paying less now than before and have 10GB's which we've never gone over. But I'm also on wifi a ton, so who knows.

Lol. Because they need it.
Funny thing is, not only will you not see aa single some of that money.... They will raise rates to cover their loss.
And people cheered for more gubment lol

pocket change for AT&T. if there is one company that'll never go out of business, it's AT&T.

This will only accelerate their pushing of the NEXT plans on all their customers.
I won't be surprised if AT&T cancels their Unlimited plans altogether and force people on Unlimited to switch to one of the NEXT plans or leave the service in the near future.

And then people will switch to Verizon. That's the beauty of the free market.

This.
However, my ATT is much faster than my work Verizon phone. Although, the coverage isn't near as good.
ETA: I almost hope they get rid of unlimited, so I can leave without feeling like I am giving up something.
