2nd degree murder is the same as first degree but without the aggravating circumstance.
Vince marinello- classic 2nd degree- planned but no aggravating circimstance ( in la- lying in wait is aggr. In California)

She had a restraining order against him...she still had bruises from the last arse-kicking she got. Heard a lot of his patients said he was belligerent and left his care.
If he was hitting a woman sounds like he got what he deserved...

Oh, you heard that huh? Well hear this, my wife was his patient and was still under his care until yesterday and I can attest that could not be further from the truth in our interactions.

The majority of patients he has cared for in his career seem to wholeheartedly disagree with that opinion. I'm sure people left his practice. I'm sure people didn't like his no nonsense, direct approach. But his practice was very successful and he was a very popular OB.

It could also just mean she's a manic depressive who struggles with bi-polar. Dates a guy, has a kid, files a protective order, then marries that man afterwards, then later shoots the man.

It may sound like I am reaching but if he abused her before the marriage, why did she marry him?

I honestly have no clue, but it's obvious she was dealing with alot of issues. How much of that was caused by him I admit to be clueless about.

There are alot of rumors flying around so it's really hard to say but right now, I don't think the previous order proves that he previously beat her any more than it proves she was just an emotional roller coaster.

There is always another alternative to shooting someone. Leave the relationship.

Hell, he's a Doctor, he can afford some nice alimony. Get out of the relationship. Murder is not justified.
