This is also on the Rant, so I will copy what I posted there:

If you were ever so lucky to be as in demand as Chavis and in your new contract with your new employer it says that your new employer will indemnify you in the event that your previous employer sues you for liquidated damages, you would absolutely sue your new employer and your old employer in a declaratory judgment action to have a judge tell either your old employer it is not entitled to the liquidated damages or to tell your new employer that it is required to pay those liquidated damages.

This is a non-issue made into an issue by people with no understanding of the law or, apparently, employment.


ETA: I also think, as said on the Rant (oddly enough), that this is a smart venue maneuver by Chavis' attorney, preempting a filing by LSU in EBR Parish and instead fighting on Aggie homeland, Brazos County.

Why is trying to see if you can get out of paying $400,000 a tool move? He probably won't win, but it doesn't hurt to try. Now I could see leaving in the first place being a tool move though.

As someone who accurately predicted the final score of this year's Super Bowl, I say this now:

Chavis will never have the success at TAM that he had at LSU. His best days are behind him.
