To be fair to him, I spotted the score without evidence it was invald. Regardless, his criminal activities, including kidnap and murder to cover other activities, demonstrates a high degree of adaptive functioning and a knowledge his activities were wrong.

Good riddance to him, period.

Big Scrub, update your title and OP. Posted 2 minutes ago...

quote:

A federal appeals court has issued a stay of execution in the case of Scott Panetti, a mentally ill 56-year-old man charged with murdering his estranged wife's in-laws more than 20 years ago in Fredericksburg.

The Fifth Circuit Court of Appeals ruling issued this morning stated: "We stay the execution pending further order of the court to allow us to fully consider the late arriving and complex legal questions at issue in this matter."

quote:

The Supreme Court has reviewed Panetti's case five times over the last two decades. In a 2007 ruling, justices reviewing an appeal of his case clarified rules on competency when they overruled a lower court's decision that Panetti was competent enough to be executed because he understood he was going to be executed.

The court sent his case back to the lower court for another competency hearing, explaining that to be competent to be executed, Panetti had to have a "rational understanding" of his execution and why it would happen.

To meet a standard of "incompetent," Panetti would have to have no understanding why he was being executed or what it meant, said Ken Williams, a professor at the South Texas College of Law who studies death penalty cases.

IF he actually had a long documented history of paranoid schizophrenia and was in the midst of an acute psychosis during the shootings, executing him is 100% wrong.

I love you, but you're bordering on being as crazy as he is. Do you have a spare room in your house, OMMG? You seem like a standup, reasonable guy and with your background, I'm sure you'll keep him medication compliant and will notice if he starts to get twitchy.

ETA: IF he had a questionable history with compliance, long periods of stability/lucidity, AND malingered to thwart mental capacity evaluations to avoid execution (BTW, all of this is supportable) - then I'm 100% okay with them executing him. But, I see that the bleeding heart Federal Courts are going to give him another few weeks/months and another bite at the SCOTUS apple (if SCOTUS even agrees.)

Answer your own question. Why are you so eager to execute an insane person?

Your boy Bill Clinton rushed home from the campaign trail to sign off on the execution of a mentally ill convict. But you were cool with that, right?

Well, not Big Scrub - I'm sure he was a Wendy Davis supporter - he has no problem with the wholesale slaughter of innocent people, but is wringing his hands about the murdering bastard, who might be crazy - or might have been crazy or whatever.

Apparently not. He claims "Texas" is eager to execute an insane person... and he his in... Texas.

It's no unlike when some one posts "This board is filled with idiots" not realizing... they are themselves one of the board participants... thus... an idiot.

I love you too Ace #nohomo

But anyways I'm only going by what I read in the OP since I don't really have time to fact check. But yes, someone who is truly psychotic should not be executed. He needs help not punishment.

That argument has long ago been determined as he was found "guilty", not "not guilty by reason of insanity." The current issue is whether he is competent to be executed based on his CURRENT state of mind.

And, btw, acute psychosis does not mean he was legally insane at the time of the crime. There are plenty actively psychotic people who rob convenience stores for non-psychotic, logical reasons(money) and know what they are doing is wrong.

I'm against executing him, but the reason is for us, not for him. I could give a shite about him.
