Neighbor shot my girlfriend's dog

I'll try to make this brief.

Girlfriend hears gunshot in her neighborhood. Notices her australian shepherd is missing. Her and her grandmother drive around neighborhood searching for him.

She finds him sitting under a neighbor's tree. After approaching her dog, she notices that his entire chest cavity has been blown open, but he is still alive and alert.

Her grandmother knocks on the guy's door and asked him if he shot her dog. He denies it and claims that he only own BB guns.

They call the police and the officer shows up and take both sides of the story. The neighbor ends up admitting to shooting her dog. Claims that at the time her dog was in his yard, his female dog, who is in heat, and his son were also in the yard. Claims that her dog growled at his son, so he shot the dog.

I ended up putting him out of his misery, as there was no saving him. He was only suffering.

This was as gentle, playful, and loving dog as they come.

Could she win in court against this guy?

Possibly. I'd say his initial lie will hurt his credibility.

should have been a good dog owner and kept the animal in it's own yard. Your girlfriend is at fault here.

looks like you have a good feud on your hands. i dont know how much of a case youd have legally, but thats a terrible thing for the neighbor to have done.

I'm not saying I'd have shot the dog, but if he's in my yard and poses a threat to my kids, I have no opposition to it

Who the frick shoots an Australian shepherd? Those are some of the least-aggressive dogs on the planet.

Someone needs to beat this a-hole within an inch of his life.

Initial lie has to be proven but do me a favor and beat the shite out of the guy too. I can understand if the dog attack the little boy then I take the dog out too but his story seems little fishy.

When a female is in heat, males will go to extraordinary lengths to get to her and, at times, will become aggressive around a female who is ready to breed. It's basic biology. Tell your neighbor he is frickwit for letting his dog out in the front yard when she is in heat. If that had been my dog, best case scenario for him would be winding up in the hospital with his jaw wired shut and a little bit of brain damage.

While there are leash laws that should protect the neighbor from potential litigation, he's a horrible human. If my dog were to get out and someone shot him, I'd be going to jail for assault and battery. I'm sorry for your loss.
