I think they mean negligently fired his gun.

Never heard of an accidental discharge.

People keep trying to figure out who to blame but it seems to me that multiple people deserve the blame here.

I'd like to see the qualifications for the SWAT officers this department uses. All of the SWAT guys I know have plenty of military experience and are 100% accountable for their guns at all times. Most of them even offer gun training courses. They would not have something like this happen, and their departments don't hire idiots with no experience either.

Guns don't accidentally go off (except for a few rare cases). People pulling the trigger makes guns go off, so he either had his finger on the trigger while going through the house and bumped something, or shot into a room with a young kid in it. Either way, he should be convicted of negligent homicide


Eta: So the grandma grabbed the gun and he just started shooting all over the place? Still negligent homicide. His finger shouldn't have been on the trigger while fighting an old lady. frick, his finger shouldn't be on the trigger fighting anyone for that matter because it will probably go off

Harboring a fugitive is a felony, correct?

Couldn't the grandparents get charged with the murder of their granddaughter if they were indeed found to be harbouring a fugitive?

While this is a horrible horrible tradegy, what do you folks suggest? Hey I got idea you be a police officer, with the holier then thou attitude yall got, I'm sure nothing will ever go wrong that would permanently devastate yalls lives like this little girls family and the cops forever.
Hey how about we just disband all police forces and bring in the military to protect us while we sleep. Don't like that? Hmmm let's just get rid of all security that we have, no police, no military no rent a cops with their flash lights. I'm sure that would work out super.

I'd imagine that someone will have to do a lot of explaining on why the officer's finger was in the trigger well so that, if true, being struck by Grandma could result in a accidental/negligent discharge. He said it wasn't but otherwise the shooting wouldn't have occurred.

Also why would someone be tossing flashbangs with officers already in the house?

As some posters have alluded, you can't claim to be professionals and conduct yourselves like amateurs.

Side note: As of 2006, Michigan law defines anyone who has an outstanding arrest warrant as a "fugitive". Escape from custody is no longer a requirement.

Considering the guy was actually there....and if the grandmother interfered as the story stated....


They were right to drop the charges.

If you strike a gun, both setting it off and moving the aim of the gun, you can't sit there and blame the officer for the ramifications. It is an accident by every definition of the term, and one that the striking individual holds more blame than the officer.
