Legal question - videotaping a bar hookup

Hypothetical situation that I'm curious about...
3 people are at a bar, 2 guys and a girl. Girl decides to perform a sexual act on guy 1, with guy 2 filming it.
Video eventually gets out and goes viral.
What are the legal problems that guy 2 can encounter for this?
No nudity is visible on film if that makes a difference. And would it happening in a bathroom change anything?

If she new Guy 2 was filming it, there shouldn't be any issue. It's a public place and she knew it was going on (ie: consent).

If it goes viral, whoever's in the video is going to have a really hard time bringing litigation on thousands of people but can for the initial person who broke it out should they be able to prove it, probably via electronic means. I think for slander, or defamation of character.. ask an OT lawyer prob one around here
