Three-time NASCAR champion Tony Stewart will not face charges in the death of fellow driver driver Kevin Ward Jr, after fatally hitting the 20-year-old in a race last month.
Ward was hit and killed in a horrifying crash that was caught on film, but a grand jury decided today not to bring up any charges against Stewart.
At an afternoon press conference announcing the decision, Ontario County District Attorney Michael Tantillo made the startling revelation that Ward was under the influence of marijuana the night he was hit and that there was enough of the drug in his system 'to impair judgement'.

That's some pretty damning evidence.

Appears the media is left holding the bag with their coverage - again.

I don't think the weed even had anything to do with it. Common sense alone should tell a person not to get and of your car and step in front of moving vehicles.

I'm glad TS isn't being charged. I believe it was an accident that Ward largely caused on his own. However, I'm skeptical about these toxicology results. A regular consumer can fail those stone sober. But, in the end, not important. I'm happy for TS and hope he's able to put it behind him.

Did he have weed in his system or did they determine there was enough to prove that he was actually high at the time? There's a gigantic difference.

More evidence that weed kills.

There's a theory held by some who study addiction and substance abuse which is that people who have "unusual" reactions to high risk situations are more prone to be susceptible to substance abuse. An example would be someone holding a gun to your head, and you didn't feel fear until later. I'm not saying all guided tower climbers, pilots, formula 1 drivers, and X Game contestants are alcoholics or pillheads, but delayed reactions to fear is an indication something is no bueno in la cabeza.

I thought this was one of the reasons it was so difficult to legalize marijuana because it was not possible to determine if there was enough use to impair judgement. I know this is one of the things opponent to legalization claim....that it isn't possible, for example, to determine the amount of pot in a persons system and when they used....

So it's open season now on people that have weed in their system? I can make reckless high speed runs at them and if I misjudge my attempt it's all OK cause they smoked a joint?
Damn. I'm booking a trip to Colorado so I can play me some real life Grand Theft Auto...

Hard to imagine many other things I would less like to do than race cars while stoned.
I used to think throwing frisbee was challenging while high.
