Not to another guy anyway.

quote:

U.S. District Judge Martin Feldman issued a ruling Wednesday (Sept. 3) upholding Louisiana's ban on gay marriage, breaking a string of 20-plus court victories for supporters of same-sex marriage since the U.S. Supreme Court struck down part of the federal Defense of Marriage Act last year.

A spokesman for the Forum on Equality, which represents three same-sex couples suing state officials over the ban, said the plaintiffs will appeal Feldman's ruling to the 5th U.S. Circuit Court of Appeal.

Feldman's ruling includes upholding the state's refusal to recognize gay marriages legally performed in other states.

Feldman said gay marriage supporters failed to prove that the ban violates equal protection or due process provisions of the Constitution.

FWIW, I really don't care much about the issue. I do believe that government should have no say in what kind of binding contracts two competent adults enter into, whether we call that contract "marriage", I don't give a shite. As long as churches are left to their own decisions.

Yay for state sovereignty and the 10th Amendment.

Now, Toddy, you and yours need to get out there and convince the electorate of the State of Louisiana that they should repeal their laws regarding same sex marriage. I'll vote against you, but I would support your effort to do so.

I fully expect Louisiana and Mississippi to be next to last and dead last in this just like they are in everything else.

Not a shock at all. The SCOTUS will deal with this issue in the near future.

Toddy can get married to any woman who will have him. His rights are equal to any other man.

Reagan appointee who is 80 years old. If you're really paranoid, he's a FISA judge, too.

I'm actually surprised by this ruling a little bit.

So a competent father should be able to sign a contract marrying his 13 year-old daughter to some competent man who pays the father $100,000 in your view. Government has a compelling interest in establishing some limitations on marriage, to include establishing procedures for dissolving a marriage.

as soon as your ideals go into effect I will be organizing The Poodlebrain Church of Orthodox Hedonists. I will offer church services to marry human adults to any mature domesticated animals, limit 3 per customer.

If the 5th circuit affirms the districts ruling and that ruling being in conflict with the 10th, 4th and others ruling, SCOTUS will have no choice but to take up the issue. Conflicting circuit courts usually get resolved by SCOTUS.

a ruling like this won't mean much in the future. I fully suspect one day in the not so distant future the supreme court will rule for or against gay marriage.

People who support the expansion of marriage to include same sex couples have not been able to prove that Louisiana's law violates equal protection.

Perhaps some posters can explain how Louisiana's law violate equal protection?

Here's the deal..I really ( and really anyone else that follows this issue)cares that some bigoted dinosaur of our judicial system in Louisiana sides with homophobia and discrimination. If this ruling was to be expected anywhere it was to be be expected in Louisiana. Gay marriage bans have been struck down in Idaho, Utah, Oklahoma, Texas, Arkansas, Florida, Pennsylvania, Virginia, Indiana, Ohio,Oregon, and Wisconsin. And soon to be Nevada after the Ninth Circuit hears oral arguments this week. These bans have also been struck down by the Tenth Circuit, Fourth Circuit, and soon to be Seventh Circuit, and Ninth Circuit. The SCOTUS WILL legalize gay marriage nationwide in either 2015 or 2016 so the Louisiana and Mississippis of this country will just have to get over it.

I DO THINK this is very embarrassing for Louisiana and am VERY glad this happened there instead of Mississippi. History will not look very kindly on this judge nor will it look very kindly on LA's elected officials for defending a law that was SOLELY enacted out of hatred for a despised minority (those aren't my words but from multiple federal judges who have already ruled on this issue).

So no worries, if I want to marry a guy in NOLA in a couple of years I'll be able to. Maybe I'll send Feldman a wedding invitation

I hope the Judge didn't say that, because if he did, he lied.
