There is a poster on another site with 40-50 races under his belt and he agrees that TS probably saw him too late. Like I said, he would have been expecting him to be in the car, not the middle of the track. The 45 car nearly hit him and that wasn't the driver's intended target.

The only reason this is up for speculation is Tony's previous history regarding his temper. I'd like to see the whole race to see if they had issues, but I haven't heard that they had (other than the previous contact).
The swerve some are talking about is because of the young man's body. RIP.
From what I see, I don't think Tony had any intent on hitting him or even dusting him.
There won't be a criminal trial or even a civil trial. Tony (or his insurance company) may elect to make a settlement, but like Roethlisberger, it will be sealed.

I like Dale Jr and don't have a dog in the hunt, but there is no way to know what his intent was, if any.
Contrary to many of the preceding posts, the only thing that there is truly no doubt about is that few of us on this board have a clue about driving a top level dirt track racer. From the little I do know, the car's steering is not designed for F1 levels of precision and the car is designed and set up to drift sideways through the corners balancing on the throttle and steering inputs. From the video evidence, he did not seem to be the highest car on the track or markedly faster than the other racers. Once committed to that corner, TS may not have had enough control to radically alter the line the car was taking and might not have been able to avoid hitting the guy in the few seconds available to react to the presence of the unexpected person jumping at his car in the middle of the track no matter how badly he wanted to or how skillfully he tried.
As for the "acceleration issue", half of the steering of these cars is accomplished with the throttle, making it just as likely that "gunning it" could be an attempt to avoid the guy.
Nobody but TS is ever going to know, so if you hate him, save the BS and just say so.

Ive been going to dirt tracks my whole life from the time I was just a little kid. My father has owned dirt track late models from the time I was about five years old and still owns cars to this day. I have been apart of well over 100 drivers both as a crew member for my father and now as a driver and I can say that at every dirt track you go to they all say the same thing. No getting out of your car unless your car is on fire or flipped over. Now with that being said I has witnessed drivers get out and show frustration towards other drivers all the time. Was recently at Hattiesburg speedway to watch the Cajun sprint cars which are the same type of cars and the vision in these cars are terrible and I've been up close and personal with them to know this. Just a terrible situation all around

It seems like the only way you can convince people on here of this is if you put them in the damn car with a helmet and hans type device to strap their heads in...
Not to mention all the other factors that would make seeing Ward pretty damn hard unless you knew he was there well before the incident took place.

If you actually read the story, it is about him threatening to run over Matt Kenseth and it was talking about the time Stewart got out his car to throw his helmet at Kenseth's car. And he was talking car vs car, not car vs person. Very misleading headline and has absolutely nothing to do with the driver killed...
