No one is coming to take your guns: States thinking of passing gun seizure laws

As state officials across the country grapple with how to prevent mass killings like the ones at Sandy Hook Elementary School in Newtown and near the University of California, Santa Barbara, some are turning to a gun seizure law pioneered in Connecticut 15 years ago.
Connecticut's law allows judges to order guns temporarily seized after police present evidence that a person is a danger to themselves or others. A court hearing must be held within 14 days to determine whether to return the guns or authorize the state to hold them for up to a year.
quote:
California and New Jersey lawmakers are now considering similar statutes, both proposed in the wake of the killings of six people and wounding of 13 others near the University of California, Santa Barbara by a mentally ill man who had posted threatening videos on YouTube.
quote:
Rachel Baird, a Connecticut lawyer who has represented many gun owners, said one of the biggest problems with the state's law is that police are abusing it. She said she has had eight clients whose guns were seized by police who obtained the required warrants after taking possession of the guns.
"It's stretched and abused, and since it's firearms, the courts go along with it," Baird said of the law.
quote:
Connecticut authorities report a large increase in the use of gun seizure warrants involving people deemed dangerous by police over the past several years. Officials aren't exactly sure what caused the increase but believe it's related to numerous highly publicized mass shootings in recent years.
quote:
Police statewide filed an estimated 183 executed gun seizure warrants with court clerks last year, more than twice the number filed in 2010, according to Connecticut Judicial Branch data. Last year's total also was nearly nine times higher than the annual average in the first five years of the gun seizure law.
Connecticut police have seized more than 2,000 guns using the warrants, according to the most recent estimate by state officials, in 2009.
quote:
"With all that we see in the news day after day, particular after Newtown, I think departments are more aware of what authority they have ... and they're using the tool (gun seizure warrants) more frequently than in the past," said South Windsor Police Chief Matthew Reed. "We always look at it from the other side. What if we don't seize the guns?'
CT was once the gun capitol of the US

If you think this wasn't a huge reason for government takeover of health care, you aren't paying attention. Government has health records for everyone, passes 'common sense' background checks for mental illness...bam. Anyone that's ever had a virus can't buy a gun.

I'm very pro 2A and I'll probably catch a lot of hell over this, but I don't see too much harm in something like this if there is very credible and sufficient evidence that the person is very clearly mentally disturbed.

The question is, where if the line... Who decides. Some would say that the owning of guns is enough to qualify someone as a "nut" and should have their guns taken...

I would normally agree, but the current administrations and makeup of our federal and state governments in the past few years have led me to believe that we shouldn't give an inch because they are dishonest people. They aren't to be trusted and they will abuse the power. I'd rather deal with the consequences of a mass murder here and there than take a huge gamble on what will inevitably lead to losing our rights.

Now define credible and sufficient evidence that the person is VERY CLEARLY mentally disturbed.
That's the rub. Supporters ALWAYS say it won't be abused and used only in EXTREME circumstances. Next thing you know, everybody on an anti-depressant or mood stabilizer is VERY CLEARLY mentally disturbed or else their doctor wouldn't have them on it right?

You do not see the seizure of private property (forget that we are talking about guns) without due process? These are ex parte hearings. In other words the individual having their property seized has no say until after the seizure occurs.
Since we are talking about guns, This WILL NOT STOP MASS SHOOTINGS.

I guarantee you that will never happen in LA or TX.
You will see 70 year old men getting shot on their front porches by federal agents. They are out-armed here.
I can see it on the left coast and the northeast, however. But let them keep putting these people in power.

I completely agree but if there's a case where someone is clearly a psychopath, I think the state should be able to temporarily disarm the as it says in the OP. I like that there has to be a trial held within 14 days so the issue doesn't languish forever.

I never thought the Feds would Audit you business, you personally, have FBI raids to your house/Business, and then have your name given to the Justice Dept for Prosecution, just because of your Politics......

The South will be the firearm and ammo production capital of the world before they are finished. Selfishly, I'm good with it.

And I'll leave this in this thread as well:
quote:
The rifle itself has no moral stature, since it has no will of its own. Naturally, it may be used by evil men for evil purposes, but there are more good men than evil, and while the latter cannot be persuaded to the path of righteousness by propaganda, they can certainly be corrected by good men with rifles. -Benjamin Franklin

Anybody that's had dealings with the feds knows otherwise. I'm pretty sure they select out the biggest douchebags they can to enforce what they want on us. Most every Fed I know has an intense hate it seems for anyone successful and with more than them. They derive more pleasure from fricking with a well to do law abiding citizen than anything else in the world. Except for maybe the occasional guilty party.

I think having a YouTube video saying that you want to murder people by the bushel would be a good example.

I'm with you.
shite, it's hard as hell to find .380 and .9mm ammo now. I'm buying up any that I see. People fear what the government is doing. The south won't go for this shite.

There is definitely some type of standardized test to ensure that they are the most pretentious douchebag with the lowest IQ, next to a monkey, before they're hired.

Judging by the mental makeup of these mass gun killers, we can deem anyone with leftist tendencies to be clearly mentally disturbed.

One of my law school buddies is from MN. He was sitting in the airport to come back to AL and asked me about laws regarding selling ammo. At a summer camp in MN they are having to pay $25.50 for a twenty round box of .22LR. I just bought 2500 rounds online for $379.00 with shipping. We are setting up the LLC for tax purposes now. If we can get a steady supply by the pallet, we will go full bore Inc.
