I guess what catches in my craw is that if it were as cut and dry as the story we're hearing and you add the fact that she works for the Police Dept there should have never been charges filed.

also.. is there a chance the evidence at the scene casts doubt on the story?

I think that would have been the case if the ex would have been some local "river bank trash." But he was a local fireman and generally held in high regard.

I thought this at first as well. Then I started thinking and read the police report and everything documented from the scene reinforces the story from the defendent and his wife. But that is what trials are for. I'll be keeping close taps on the procedings. They are currently in the first day of trial today. I have no idea as to how long it could take.

Not having much experience with trials by first day does that mean they're hearing testimony and stuff from witnesses or picking jurors?

Jury was picked on April 10th according to one of the FB updates I saw. I assume they are in the first day of hearing testimonies. I've never been in/to a trial so I can't say for certain.

I remembered this thread from a few days ago and just saw on my news feed that your friend has been aquitted of all charges. Sad that it had to go this far, congrats to him.

I hope he can. Lawyers are expensive, especially in a manslaughter case. It was complete BS he had to deal with this.

For me it really depends on the situation. If the person is in my house and has established his or herself as a threat, I don't care if the back is turned to me. They could just as easily run away and fire a gun blindly behind their back. Self defense encounters are unpredictable and there's no telling whether or not a perp will still be at threat with his or her back to me.
Sorry to make an example of you but I hate how people generally think if a back is turned that the threat is over. That is not the case.
But, all of this is contingent on the perp being armed. If there is no gun, knife, club, bat, baton, etc. and he or she is running away, I think letting them flee is the best option.
As for the OP, good to hear he got off!
