in mississippi you just have to "feel" threatened. they dont even have to be in your home, if they come in my driveway and feel threatened i have the right to defend my property

What would that entail? Serious question. I know very little about CC'ing as I bounce around from state to state working and would quickly tire of keeping up with all the differing state laws

• CAN NOT carry in a Courtroom or Law Enforcement Office or detention center.
• CAN NOT carry in Polling Place or meeting of the Government.
• CAN NOT carry at any School, College or Athletic Event.
• CAN NOT carry at establishment or portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises primarily devoted to such purpose .
• CAN NOT carry inside the passenger terminal of any airport .
• CAN NOT carry in any church or other place of worship.
• CAN NOT carry any place prohibited by federal law.
• CAN NOT carry where Private Business displays “NO FIREARMS” signage
CAN NOT carry in Parades where permits are required.

and with Enhanced Carry Permit here are only limitations
• CAN NOT carry in courtrooms during a judicial proceeding .
• CAN NOT carry in any police, sheriff or highway patrol station or any detention facility, prison or jail.
• CAN NOT carry any place prohibited by federal law.

so even if they have a sign that says no firearms.. if you have enhanced... you trump their sign

Well in MS, it isn't all that difficult to get a regular CC permit.

But, there is a full 9 hour class for "enhanced" carry and it basically enables you to carry in quite a few "gun-free zones" compared to other states.

For example, under state law, a student with the proper enhanced permit (21 years or older too, of course) would be allowed to carry on school campuses. Now, the grey area is that carrying is probably against school policy, even though it isn't against the law. So if the school caught you, they would probably dismiss you, but you wouldn't face any criminal charges.

I'm not a MS resident but I'm pretty sure that's how it works.

Obviously the version they heard couldn't have been this onesided.

Is it possible they planned this out because of some custody issues not disclosed in the article? Why would they arrest him for obviously defending his family with witness corroboration by their very own radio dispatcher unless there were inconsistencies in the story.

So it is ok with you if somebody comes into your house without being invited in, as long as they don't force their way into the house?

Whether the door was improperly closed and he opened it, or he kicked the door in, it doesn't matter. He still came into the house without permission.

Based on Louisiana's justifiable homicide statute (RS 14:20), your position, and those posted by others should have merit.

But there was a very similar case in Rayville a couple of years ago .. in that case it was the ex-wife who barged in, after driving through the front yard up to the front steps, and attacked the "new" wife. Hubby grabbed a rifle and shot the former wife.

Hubby was convicted of murder, and is in prison. He appealed and lost (La. Second Circuit Court of Appeals).

The Rayville case involved some fairly prominent families. Go figure.

I don't know what I would do in that firefighters situation. I would just about prefer death to not being able to be there for my kids.

I don't know what caused that woman to leave her man, but shite like this is why you don't enter into marriage and kids lightly.

As I think about it more, the original shooting was be older than two years -- the appellate ruling was handed down (I think) in late 2011.

Lemme look at my files, and I'll post a link.

Edited to add:

OK -- found it.
State of Louisiana v. Bobby Ray Ingram.

Shooting took place October 18, 2006.

Was charged with second degree murder, convicted of manslaughter, and sentenced to 28 years at hard labor.

2nd Circuit Final ruling handed down June 22, 2011.

Maybe he was going to have the courts prevent her from moving with the kids. Surely if his family is influential enough to get someone charged with murder they have enough influence to keep his kids near home. Plus I'm not sure to what degree custody influences one's ability to relocate children. After all he was a good guy up until that night so wouldn't it stand to reason he'd have equal custody.

Hypotheticals:
1)Someone is banging loudly on your front door. Do you lay on the couch and let your wife go look outside, get a cell phone, check missed calls, call ex husband and then get assaulted by ex husband without getting up to see WTF is going on.
2)You're highly pissed and ready to kick some serious butt. Do you open the door, whether locked or not, like a pansy or do you kick it in using your special firefighter door smashing skills?
3) With young kids in your family, do you just leave your loaded gun lying in the living room even if they're not home?

Maybe the whole thing was staged to look like self defense in order to murder the ex and gain sole cutody of the kids and move them wherever they pleased.

Both could've heard the loud banging, and figured since the door was locked, he wasn't getting in and the situation would just take care of itself and he would leave.

Maybe he has a CCW or was out in his yard/woods (I dont know the area) where possibly snakes are prevalent and he was carrying. He comes in, sits on the couch, and sets his gun on the end table.

It wouldn't have mattered to me if he was assaulting me or my wife. The minute he came in without permission I would have assumed he meant to do harm and would have shot him.

That man did the right thing.

So many people own guns but are completely ignorant as to where & when they actually require use.

I can't tell you how many people I've talked to that would say in a similar situation, they would pull their weapon and stand there in a Hollywood standdown until the person left.

Bottom line: you pull a weapon, you best be prepared to kill.

Kudos to that guy. I hope he gets off.
