would imagine most people who claim that Ledger's performance was miles ahead of Jack's are too young to remember Jack's performance at the time it was released. They probably only watched it on video. Jack's performance was great for its time. Very few people who saw the original Burton Batman in the theater weren't blown away by it and didn't love Jack's performance.
The problem with watching "clips head to head" is that they are two totally different movies, basically different genres, as others have pointed out due to the 20 years that separate them.
While Ledger's performance is great, I agree that he would not have won the awards that he did, or even been nominated, had the circumstances been different.
Honestly, does anyone think that Jack wouldn't have won an Oscar if he died just after filming Batman and before the film was released? He would have won BEST actor, not Supporting actor.
People who pretend that didn't influence the way the performance is looked at are just being dishonest.
All of this.

This.
Jack's Joker sucked. It was too influenced by the campy 60's show.

Damn, the original Batman is twenty years old. I didn't realize how old I was. I saw that in theaters, and loved it at the time.

I was 20 years old when Burton's Batman came out. I thought it was a great film and that BOTH Keaton's and Nicholson's performances were top notch.
Nolan's Batman and TDK completely blow the 1989 version out of the water (as do Bale's and Ledger's performances as Batman/Wayne and The Joker, respectively).
It's not that the earlier version (and the performances of the actors in it) is not still good, it's just that the recent version is so much better.

Personally, I think Mark Hamil does the best Joker... well voice of Joker.

This true too. And if Hamil were younger he would have been my number one choice. He gets the Joker better than anyone else.

The animated Batman series from the 1990s was great. Bruce was a pimp and Batman kicked arse. Hamill's Joker was good. The storyline w/ Raz Al Ghul (and his daughter) were very good.

Jack's the better actor. Heath was the better joker.

while i don't think this quite is the apples to apples comparison it seems to be at first blush, the answer has to be Ledger

yeah, Bale's grunting to the point of not being able to make out what he said in the movie proved he was a far superior actor

Ledger easily.
Nicholson's Joker and Frank Costello from The Departed were the exact same character with different costumes.

I know Bale takes a lot of heat for the growling voice, but after watching TDK a few times I realized why his voice is egrigiously harsh at the end...because he's hurt after his fight with the Joker. He's hurt, winded, and still trying to do the disguised Batman voice. At least that's what I tell myself, so I give it more of a pass than most.

Not trying to be a dick, but I don't see this.

There really wasn't that much for him to go against.
Heath Ledger - The Dark Knight as The Joker (posthumous win)
Josh Brolin – Milk as Dan White
Robert Downey, Jr. – Tropic Thunder as Kirk Lazarus
Philip Seymour Hoffman – Doubt as Father Brendan Flynn
Michael Shannon – Revolutionary Road as John Givings

He was good in Doubt, but I don't think it was his best, and I'm a big PSH fan. I liked the young nun better

people underestimate Ledger's performance and say he won based off his death, but answer a question for me? when you see him arrive on the screen in the movie with that psycho laugh, do you even realize you are watching Heath Ledger?
