Getting into interesting legal territory if ICE is stopping trucks that far from the border. Unless they’re “accompanying” state police/inspections.

They’re generally held to reasonable suspicion standards on searches more than 100/150 miles from the border.

We know that many states are issuing illegal licenses — ICE has the right to inspect any truck anywhere with the info we currently have

These trucks are driving on interstate highways - interstate highways are owned and maintained by the federal government

in fact; they were started by Eisenhower as a way to get daily transport troops - any vehicle on an interstellar highway is subject to inspect federal authorities

This should not be an issue in any way shape or form

I mean yea. But that’s not license to conduct a search of a vehicle on the interstate either.

Again I’m not even opposing what ICE is doing. I said it will pose interesting legal questions in the limit of their ability to conduct warrantless searches so far away from the border.

I don’t know about interstellar highways, that’s above my pay grade. But the same standards for a search apply to your car on the side of I-10 that apply to your house. LEO, fed or otherwise, cannot just pull Tyler Baw over and search his truck because he’s on the interstate.

Now, ICE and CBP get latitude near the border because there’s a degree of imputed reasonable suspicion involved.

If they are operating and doing business on a federal owned road, why can’t the feds pull them over and verify they have a right to be driving?

Asking for papers? I’m sure they could, can, and do.

Searching the trailers is where it gets a little more different.

And besides, I’m sure they’re coordinating with state inspection officials. My initial post was genuine interest on how it would be handled if ICE started playing highway patrol for trailers nationwide on their own. But you guys are so wound up and paranoid that such a sober discussion isn’t possible.

not if they determine an illegal is driving - if an illegal is driving, then a crime has been committed and that creates probable cause

So, there should be no problem

If the driver is legal and has a right to be driving, then a warrant is certainly needed to inspect the cargo

If it’s an illegal, then all bets are off
