Federal judge slams brakes on Trump admin rule limiting commercial driver's licenses for immigrants

quote:

A federal appeals court in Washington, D.C. ruled on Thursday the Department of Transportation's (DOT) restrictions on immigrants obtaining commercial driver's licenses cannot be enforced.

The restrictions were announced in September, after an illegal immigrant truck driver was accused of causing a tractor-trailer crash that killed three people in Fort Pierce, Florida.

Harjinder Singh, an Indian citizen who allegedly illegally entered the U.S. from Mexico in 2018, pleaded not guilty to three counts of vehicular homicide and three counts of manslaughter after allegedly jackknifing his truck during an illegal U-turn, causing a van to smash into the side of the tractor-trailer.

The court found the federal government did not follow proper procedure when creating the new rule, or explain how the rule would promote safety.

quote:

The new DOT restrictions would allow immigrants who hold three specific classes of visas to obtain commercial licenses valid for one year, and require immigration status to be confirmed via a federal database.

Though the rules would disqualify about 10,000 of the 200,000 current immigrants with commercial licenses, the rules would not be enforced—meaning drivers could keep their licenses until they expire.

The Owner-Operator Independent Drivers Association (OOIDA), which represents more than 150,000 independent owner-operators, thanked the administration for its efforts to "restore commonsense safety standards" in an Aug. 26 statement.

"OOIDA applauds the Administration for seeing through the myth of a truck driver shortage and continuing efforts to restore commonsense safety standards on our nation’s highways," OOIDA president Todd Spencer wrote in a statement. "Pausing visas for commercial truck drivers will help ensure only qualified individuals get licensed. Additionally, there is unlikely to be any negative effect on the supply chain, as the trucking industry continues to face overcapacity."

"The misuse of visa programs along with the rise of non-domiciled CDL holders in recent years has fueled a flood of drivers into our country who struggle to operate safely in full compliance with regulations," Spencer continued. "We are working with the Administration and Congress on implementing more comprehensive licensing and training standards that will prevent unsafe drivers from ever getting behind the wheel."

Secretary of Transportation Sean Duffy announced in October the administration is withholding $40 million from California over its refusal to enforce English language requirements for truckers, Fox News Digital previously reported.

To have funding reinstated, the state must ensure state inspectors test truck drivers’ English during roadside inspections, and remove those who fail.

I am so tired of hearing about these federal judges who fight our president on every thing he does to make this country great. Where were these maggots when Biden created his mess?

Wait for tomorrow's identical thread, so it does not interfere with SEC football.

Don't worry. It will be there.

Past time to remove qualified immunity from these judges. Let them make all the rulings they want to make and then hold them accountable and responsible. They would change their tune fast if their actions came back to them.

California did revoke the CDLs of 17,000 illegals who had overstayed their visas.

But Im fairly certain they would not give those names to Homan

DIMS and liberals are willing to issue licenses for semi-truck drivers without proper testing, which should be concerning to most rational people. How do we know if someone can even operate a semi-truck, let alone read or understand road signs? In contrast, many countries maintain rigorous testing procedures for all drivers, even for a basic car license.

Most European nations have strict requirements for obtaining a fundamental driver’s license. For example, when I lived in the UK, I had to pass a comprehensive theory exam covering all traffic rules and hazard recognition. I also faced a demanding practical test that assessed various driving skills. Below is a summary of the UK driving test requirements.

One part of the practical test involved pulling over and then being told to navigate to an unfamiliar town using only road signs. Which is more challenging when you did not grow up in an area. Interestingly, I had to drive a manual car to get my license, as most UK cars are manual. It was not a big deal for me to drive a manual since I learned at a young age, but many in the US no longer know how to drive a manual and would have to learn this skill if they wanted to drive an type of car in the UK.

My brother and sister-in-law, who lived in Germany, also shared how difficult their driving exam was.

**What the UK driving test evaluates:**
**General Driving Ability:** This includes skills like using mirrors, signaling, approaching junctions, pedestrian crossings, and following directions. A key part is the independent driving section, where you follow signs or a sat-nav for about 40 minutes.

**Maneuvers:** Candidates might be asked to perform tasks such as parallel parking, bay parking (reversing in and out of a space), or pulling over on the right and reversing.

**Eyesight Test:** You must read a license plate from 20 meters away as part of a visual acuity check.

**Safety Questions:** At the start, you'll answer a 'tell me' question about vehicle safety, and during driving, you'll perform a 'show me' demonstration.

We would never get the votes if we impeach. If a competent DA investigated the judges, there would be all sorts of improprieties and conflicts of interest that could allow for forcing them to resign. But alas, we would need to have a legit DOJ and FBI and those don't exist.
