Most ironic line in the article about the lawsuit.

“To the contrary, LSU repeatedly confirmed, both publicly and to Coach Kelly, that the termination was due to the Team's performance, not for cause."
If there ever was a cause for termination…
I get the legalese, but it just has me shaking my head that in any context you can bottom out in your profession and still come out filthy stinkin rich.

The fact that LSU is trying to wiggle out of this contract makes them look like shite. LSU will look like used car salesmen now....shady as frick.

LSU put in the contract what it constituted to be cause. Performance of the football team was not included.
Pay the man and move on.

If it has you shaking your head, then you dont “get the legalese” or understand how contracts work, or why they exist

This is all just big boy games by both sides. Kelly knows he screwed up and had an affair that was potential grounds for termination of his contract, but LSU didn't enforce at the time. To LSU's point, it would be irresponsible not to seek a reduction in the buyout using whatever leverage they had. There does not seem to be any timeline on enforcing the morals clause, and LSU is still paying Kelly according to the contract. According to Kelly's lawyer's allegations, LSU is claiming that the contract is still in place as Wood did not have authority to fire him. This makes some sense as we know the BOS had to approve Kelly's hire, so why not also have to approve his firing.
Prior to LSU filing its response, I anticipate that there will be an agreement on a buyout settlement around $35m paid out entirely within a year or two and without the mitigation clause. It makes sense for both sides.

Well, that might be how it looks as at a casual glance
But honestly, I’m 59 years old and I’ve never played 400 rounds of golf in my life and I am a fan of golf but I have to work as a business owner. I don’t have time for freaking golf.
All I’ve heard my entire life is how hard coaching is have to work and that’s why they get paid so much money because of the pressure and obligations to win at an elite level
Kelly took the money and then checked out… that is not the reason we hired him…
He did not in good faith, honor the agreement by putting his best effort into the job
When you hear stories of he didn’t know all the players names
When you hear stories about him drinking wine in the office
And when you hear stories of adultery in year one and that’s why his wife filed for divorce then you’re dealing with a guy that’s not committed to the agreement that’s been made
That is cause for firing beyond the wins and losses. The wins and losses are a result of not putting in the work.

He signed a contract and nothing in the contract talked about working hard. Coaches and players have agents to vet these contracts and protect their clients for situations like this.
Like it or not, the people in charge gave a 60 year old a massive contract and it was a bad decision. At the end of the day, they are going to have to pay for it.

They’re offering buyouts, Dave

Never knew any of that - other than the piss poor product he shoved out onto the gridiron.
He should have been fired without recompense well before the whole team got betrayed - and the stigma he attached to our brand should be the subject of a lawsuit against him.
Fukc that bastard.

adultery in year one
that alone is all you need to kick his arse out of the state - demonstrated no commitment to the needs of the job at all - anyone working his arse off to develop a good team given situation he hired to fix does not have time to go out chasing tail and creating excuses for his wife.

No, they’re not. They’re saying, very publicly, we didn’t really fire you last week. No matter what you heard us say, we didn’t really fire you then. We’re actually firing you now, for cause.

Would've been just fine if he was winning

well, that's the level of scruples that they're dealing with in coaching and agent circles

No you don’t.
Unless the contract had specific performance standards, you can’t simply void it due to excessive losses

Agreed. What LSU is doing right now will have lasting consequences on its ability to attract top coaching talent. For better or worse, the university is setting a precedent that says LSU won’t honor its contractual commitments. Why would any quality coach trust a future agreement if a single bad season could lead to the school manufacturing “for cause” claims just to avoid paying out a contract? In the business world, that kind of behavior would destroy your reputation and make it impossible to recruit top talent. Shame on LSU, just admit you made a mistake by offering such an egregious deal and move on.

They’ve literally made 2 offers that were rejected

When every news outlet is reporting on this it shines a light on LSU’s hypocrisy - Stating they didn’t fire Kelly, and now claiming they intend to fire him “for cause”. it really exposes how deep the dysfunction runs. It makes LSU look foolish. You’d think the university would at least consult its own law school before releasing public statements that completely contradict their current position. What LSU is doing isn’t legal posturing, it’s deception and narrative manipulation. If a business acted this way, it would be sued for libel. At this rate, LSU might end up paying Kelly even more if they keep going down this path.
