President Donald Trump’s administration asked the justices to revive a case against a Texas man charged with a felony because he allegedly had a gun in his home and acknowledged being a regular pot user. The Justice Department appealed after a lower court largely struck down a law that bars people who use any illegal drugs from having guns.

The Republican administration favors Second Amendment rights, but government attorneys argued that this ban is a justifiable restriction.

They asked the court to reinstate a case against Ali Danial Hemani. His lawyers got the felony charge tossed out after the 5th U.S. Circuit Court of Appeals found that the blanket ban is unconstitutional under the Supreme Court’s expanded view of gun rights. The appellate judges found it could still be used against people accused of being high and armed at the same time, though.

Hemani’s attorneys argue the broadly written law puts millions of people at risk of technical violations since at least 20% of Americans have tried pot, according to government health data. About half of states legalized recreational marijuana, but it’s still illegal under federal law.

The Justice Department argues the law is valid when used against regular drug users because they pose a serious public safety risk. The government said the FBI found Hemani’s gun and cocaine in a search of his home as they probed travel and communications allegedly linked to Iran. The gun charge was the only one filed, however, and his lawyers said the other allegations were irrelevant and were mentioned only to make him seem more dangerous.


The case marks another flashpoint in the application of the Supreme Court’s new test for firearm restrictions. The conservative majority found in 2022 that the Second Amendment generally gives people the right to carry guns in public for self-defense and any firearm restrictions must have a strong grounding in the nation’s history.

The landmark 2022 ruling led to a cascade of challenges to firearm laws around the country, though the justices have since upheld a different federal law intended to protect victims of domestic violence by barring guns from people under restraining orders.



Why is Trump so weak on the 2nd A and even attacks it from time to time like bump stock ban?

Trump isn't so much weak on 2a as he is 100% against all drugs. I think he needs to chill on weed users. This would create millions of felons overnight.

What about regular drinkers who have firearms? Better cut them off, too.

You know, the drunks with guns concern me a hell of a lot more than the pot smokers.

Trump should just declassify weed.

That would go a long way to fixing a lot of the simple issues that become complex. Cops use weed too often as a "reasonable cause" to do other things which makes many citizens unhappy with cops.

Yea this is really stupid and a waste of resources and time. We have a ruling from the lower court already that aligns with the Consititution. Leave it alone.

Yessir. I'm on a badgecam kick (sucks for me, but its addicting) and the only times I get pissed at the cops is when they force that stuff.

There are usually state laws that address this.

It was maybe 15 years ago that SCOTUS threw the 4th Amendment and search warrants out the window when they allowed a cop's claim of smelling marijuana as reasonable cause for a warrantless search. That allows them to search your vehicle at any time for the price of a simple little lie with absolutely zero chance of repercussion on them.

Yep and people will drop their MM cards and go back to home grown or whatever they can get, which the cartels usually fill the void..with fentanyl lace mj.

Will cost states with MM tens of millions of dollars in taxes and card fees.

They just need to decriminalize it federally and let the states decide. Would be a good first step.

On an episode of the original Live PD some cops pulled over a SUV with a man and his wife. It was raining and the wind was blowing. Cop said he smelled something and asked them to let them search the vehicle. They refused, stating there was nothing in the vehicle. Ol' boy called in dog unit, they waited 15 minutes. The officer arrived on the scene, got the dog out, ran it halfway around the vehicle for maybe 20 seconds, and said it "hit". The dog was on camera the entire time and it never changed its behavior.

They pulled the two out of the SUV and started pulling their shite out in the rain. A half hour or more later......nothing, they found absolutely nothing. They left the pair to put all their wet shite back in the vehicle themselves.

Similar cases happened on that show often enough to realize it is a problem.

Drug dogs, or more accurately their handlers, are bullshite and should not be allowed as probable cause.
