Supreme Court being formally asked to overturn Obergefell; gay marriage will fall

I have been saying this ever since Roe vs Wade fell. The only SC case with worse legal reasoning that Roe is Obergefell.
This SC is certainly going to come down 5-4 and just like with Roe say if you want gay marriage legal, pass it in the legislature. Expected to take this up in the fall

Wait so gay marriages will be illegal and grounds for persecution? Will it go back to the states and be legal in some states and illegal in others?

Obergfell is based on a few cases that established the reasoning, so the question becomes if it falls, do Loving and Griswold also get reversed?
Also Tim Pool is being over-dramatic. The USSC being asked to overturn a case is close to a nothing burger. There's a long process before the writ would be accepted.

I can’t watch someone wearing a damn beanie cap indoors, and in the middle of the damn summer at that. What the frick is wrong with people?

There’s no way you had time to watch the entire 20+ minute video already. He goes through how this person is the only person with legal standing to challenge the precedent, and that it’s expected they will take this up in the fall session

Go google it, there’s plenty of other news sources covering this if you prefer to read about it instead of a video

I'm shocked.

I don't need to.

When that happens, then it will be worthy of a 20-minute video.

So why are you commenting in a thread you’re actively admitting you aren’t even putting in the most minimal effort into looking into the OP?

Holy shite, I just read the article he's being histrionic over
It's crazy Kim Davis again. She's asking that a civil judgment be overturned
quote:
Kim Davis, the former Kentucky county clerk who was jailed for six days in 2015 after refusing to issue marriage licenses to a gay couple on religious grounds, is appealing a $100,000 jury verdict for emotional damages plus $260,000 for attorneys fees.
In a petition for writ of certiorari filed last month, Davis argues First Amendment protection for free exercise of religion immunizes her from personal liability for the denial of marriage licenses.
quote:
More fundamentally, she claims the high court's decision in Obergefell v Hodges -- extending marriage rights for same-sex couples under the 14th Amendment's due process protections -- was "egregiously wrong."
"The mistake must be corrected," wrote Davis' attorney Mathew Staver in the petition. He calls Justice Anthony Kennedy's majority opinion in Obergefell "legal fiction."
quote:
Lower courts have dismissed Davis' claims and most legal experts consider her bid a long shot. A federal appeals court panel concluded earlier this year that the former clerk "cannot raise the First Amendment as a defense because she is being held liable for state action, which the First Amendment does not protect."
quote:
"Not a single judge on the U.S. Court of Appeals showed any interest in Davis's rehearing petition, and we are confident the Supreme Court will likewise agree that Davis's arguments do not merit further attention," said William Powell, attorney for David Ermold and David Moore, the now-married Kentucky couple that sued Davis for damages, in a statement to ABC News.
This is retarded, even for MAGA echo chamber nonsense.

I just destroyed Tim Pool and any person stupid or emotional enough to believe his drivel in that video.

Also as things currently stand if it’s returned to the states like Roe 35 states currently have marriage equality ban laws meaning gays could only be married in 15 states.

Tim Pool is a dumbass attention seeking whore.

Do you mean "prosecution?" No one would be prosecuted for pretending to be married. There's no law against impersonating married people. They just wouldn't get the government benefits and privileges afforded married people.

That would be my guess.
Gay marriage never got much traction when it was up for public referendum before Obergfell but times have changed, so I would imagine that the vast majority of states would affirm and legalize at the state level.

Yup I’m sure you said the same thing about Roe vs Wade counselor. How’d that work out for you?

You destroyed nothing. I remember people like you saying the exact same shite about roe vs wade for decades.
And she was sent to prison. Hardly a civil judgment
You’re also quoting the people who brought the charges against her as if they’re some unbiased source of info we should trust

Yeah, but I bet most of those would change quickly.
I would guess once the smoke cleared it would be the other way around, where there might only be 10 or 15 states in which gays couldn't get married.
I could be wrong, but that is what I would put my money on.

That's non-responsive to Tim Pool misunderstanding what the article he's discussing says.
This is an appeal from a civil judgment. It was laughed at, at every level and has probably a 1 in 1M chance of getting cert on that issue, let alone the unrelated attempt to overturn Ogberfell
