so the one dude that's making waves with NIL has been consulting Trump on this?
yeeesh, expect the wild west to continue
quote:
College sports leaders, including SEC commissioner Greg Sankey and billionaire Texas Tech booster Cody Campbell, are some of the leading voices behind NIL change, but didn't expect the announcement this week.
Campbell has spoken at length with Trump this summer about ways to stabilize the rapidly changing landscape of college sports. Campbell told USA Today he "hadn't heard anything" about Trump's order, but was not caught off guard by the news.

No matter what side of the political isle or NIL debate you fall on, I’d hope that we all could agree that nobody’s compensation should be limited by the damn federal government unless you work for them.
I miss the days when conservatives truly believed that more government involvement was generally a bad idea.

This one is particularly egregious because where is the federal jurisdiction over college sports?

Article I, Section 8, Clause 3 of the Constitution. This is commerce clause stuff—directly in the purview of Congress. Will likely be defeated in a District Court challenge.
Read this for more information
quote:
Finally, courts also apply strict scrutiny to state laws that operate ex- traterritorially—i.e.., laws with the “practical effect” of regulating commerce that occurs “wholly outside” the State’s borders.120 Although SB-206 and its sister statutes are non-discriminatory and deliver important in-state benefits, they cannot escape strict scrutiny under the Supreme Court’s extraterritori- ality jurisprudence because sports leagues are a unique setting in which com- petitors must agree to abide by the same rules, whether those rules govern qualifications for athletic participation or the field of play itself. State NIL laws therefore force the NCAA to change its rules on a national scale and regulate commerce occurring wholly outside the State’s borders

Those files will never be released because both sides of the aisle have people that would be exposed.

WTF? This guy? He's the very worst example of what's wrong with NIL
It's like putting the Dodgers in charge of a MLB salary cap.

Agreed.
Never a fan of the government getting involved in these situations. I imagine this could also present a big anti-trust issue when monopolized this way.

I agree, which is why the issue is tricky because the way its going currently is clearly also problematic.
There are industries where the fed effectively does limit earning potential when it comes to federal contracts and things in the realm of the public good like Ag products and vaccines.
Is the competitiveness of a popular sport "public good"? IDK. In a cynical "bread and circuses" sense I guess so, from the perspective of the government at least.
I think it also complicates things that many of these NIL deals aren't anything about N, I, or L, its just about getting a guy to play for your team. Paying for a massage with a wink and a nudge will still get you arrested if the place gets raided mid-tug.

Neither party (the players or schools) will do what is in the best interest of the other voluntarily. The big schools with the most pull are only sort of fine with the current model because they are at an advantage. If they could change to a fixed income model they would in a heartbeat. The players want the current insanity to continue.
You kind of need a third party arbitrator in this scenario, which would probably be the government unfortunately. In an ideal scenario they set up some kind of sustainable system and just get out of the way after that, but we all know that isn't what usually happens when it comes to the government.

The current bloat of the university system is only possible because of federally-backed student loans. NIL bloat will only add to college expenses because it diverts donor funds from the institutions to individuals.
The value of the programs, and therefore the value of the players with only a handful of exceptions, comes from being tied to the federally funded university system.
Do you think the feds should have no regulatory oversight over a system they effectively created?

This statement pretends the government isn’t involved in the first place, but in reality, we wouldn’t have massive state universities without the feds, and without massive state universities, college athletics would not have the type of financial power it does.

Go back to the cesspool, sorry the Poli Board.

IMO the competitiveness of a popular sport is literally a pimple on the arse of the problems facing this country and the world. But I understand such things are the subject at hand on this board.

I'd say it worked pretty well in regards to shutting down the boarder.
Correct?
