Is it legal to ask if a prospective employee has ever participated in a political protest?

Asking for a friend.

Is it your company or not?

Probably not.
I wouldn't give them any ammo to use as a claim of discrimination. No political questions. No "what church do you go to" questions.
If they look like a lib, just don't hire them. Go with someone else.

Federally, I doubt it. However, it probably depends on the state.

I don’t know, but those types always make their activism clear on social media

Just do a search of their social media before you agree to interview. It’s not illegal to view open social media accounts.

In the eyes of the law, it is likely the same as asking if you have ever cooked a turkey.
Although i think California has some pretty weird employment laws related to politics that were initially put in place to protect Communist. And they are now being used by Conservatives that were shite on the past decade.

Yep. Just do a quick Facebook/IG search on the prospective candidate. If they're a prog dim, it's plastered all over their page and they're too dense to fathom how it could affect their personal life. And that information is guaranteed to be there, because they won't have their profile "private". They want the entire world to know how they feel.
I know someone who literally can't get a job outside of being a part time convenience store cashier for the past 10 years because he always gets weeded out immediately after employers do minimal digging. When you're on socials constantly talking about suing your "capitalist pig employer" for discrimination, don't expect a real job to give you a chance.

Don’t ask. Do a thorough background search.

Is it illegal to lie and answer no?

It doesn’t fit in any of the biggies (age, religion, pregnancy, gender, etc) so I don’t think that’s a problem. If you’re applying at the RNC wouldn’t it be fair to ask if you protest with Antifa?

100%. My company was preparing for an interview with a really qualified gay candidate. We knew he was gay and that clearly is not an issue. But, when we dug into his social media, he literally participated in every single social issues protest you could attend within a 500 mile radius of his home. We went a different direction.

You’re a moron if you ask that in an interview

Yes, but only if the candidate is a Black female, in a wheelchair, and is over 40.

Check social media. If they are an activist type person they will deffinately be on SM.
But any rainbow colored hair, face tats, or facial piercings are a strong no. Or gauged ear lobes.

quote:Just ask, "What are your views on employees taking off from work for the purposes of protesting, assuming the company itself is operating normally, and not closed to encourage protests?"
Probably not.
This should be allowed as a standard question. It only asks applicant for an opinion. It does not racially profile, age discriminate or could be construed as tied to a federally protected characteristic, such as race, religion, or national origin, so should not raise concerns under anti-discrimination.
However, it will have served a purpose if this triggers an applicant while being interviewed.

If you have to ask, no...

Imagine a bunch of people not hired for attending tea party rallies back in the day or any of the protests now, like those who went to the January 6th rally.
Although, any employee who is truthful (admitting to going to any type of protest) shouldn't be hired for being dumb.
Why would you tell your employer anything about your private life?
