Frick him.

“At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions. He did not. His actions were illegal — both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor of the State of California forthwith,” the judge wrote.

Then he is a domestic enemy and the National Guard is sworn to defend us against him.

The opinion was well-written. we’ll see.
SCOTUS will be hesitant to greenlight
military in the streets.

What’s the point of having an executive then?

This has every sign that this was just a political judgment. It will be dropped or reversed (if it hasn't already been already) very soon.

Who is responsible to protect federal personnel against harm if the state won't do it? Hesitant, my arse.

That doesnt make it right. There is precedent for Trump's actions. None for Breyer's.

We have a SCOTUS case on point saying this is a nonjusticiable case!

I'll say this, your consistent.

No justiciable controversy is presented in this case, as the relief sought by respondents, requiring initial judicial review and continuing judicial surveillance over the training, weaponry, and standing orders of the National Guard, embraces critical areas of responsibility vested by the Constitution, see Art. I, § 8, cl. 16, in the Legislative and Executive Branches of the Government. Pp. 413 U. S. 5-12.
How does our learned trial judge distinguish Gilligan v. Morgan?
Edit:
Answered my own question—the judge basically skips over the standing analysis. What a horrible opinion.

Not only that the outcome was never in doubt with this judge.

tell that judge to eat shite and die!
Posted on 6/12/25 at 9:27 pm to RockyMtnTigerWDE
The opinion is a joke. The founding fathers never imagined that lowly federal district court judges would someday be dictating control over military matters or the national guard.
