An HOA in Florida is sueing a disabled veteran for flying the US Flag on his own property. And they're sueing him despite both a federal and state law that prohibit HOAs banning homeowners from flying the US flag.

All I can say is you reap what you sue.
On the other hand, if his flag is that frayed he should be able to sue it back together and remain in compliance with the HOA.

That HOA is clearly wrong. Doesn’t mean all are.
Never ceases to amaze me that people want to buy a house in a nice neighborhood and then bitch about getting a letter for putting their trash on the curb three days before pick up.

Your threads are always crying and bitching. They are predictable. Should he be sued? No. I appreciate my HOA. I've had no problems with them.

I hate to be "that guy" but it is an interesting dichotomy between the hoa rule to submit an application and the law that allows the pole and flag
I wonder the timeline between hoa docs and the law and also the new Florida laws in hoa

As I suspected, this is one of those flagpoles in the front yard.
If you want to fly a flag, put it on the front of your house like a normal person. Those guys who try to make their house look like an official building with the flagpole are eyesores.

What the frick is the HOA’s argument? There’s no way they can win this, right? If I were the neighbors, I’d fly an American flag in solidarity.

Florida law allows a flagpole up to 20 ft on residential property. His flagpole is in compliance.

The contract pays them per violation letter they generate. So you can imagine the trivial bullshite they come up with. Especially around subjective things like what is a weed.

Also, there is some stealing and brother in law deals going on with the budget. I've seen them pay $50,000 to landscape the entrance around a front gate. Trouble is the entrance was already beautifully landscaped. And only a few new shrubs and a small new tree planted. This was when the neighborhood lake pump was out. That should've been fixed way before unneeded, exorbitantly costly landscaping was done. My neighbor went to a board meeting and called out the president who signed the $50,000 check. The board didn't do anything. Next election that president lost and then moved out of town. Go figure.

He should know if it’s that bad the local VA group will give a replacement for free.

I would never be in an HOA for this very reason ,but no one put a gun to his head to buy that house. He knew it was in an HOA, he knew that was thier retarded rules, and he can't cry after the fact that they are enforcing those rules. Also if you read the article, it isn't the flag itself, he erected a flag pole without permission. I am sure living in under an HOA sucks ,but again their rules and I have no sympathy.

Seems like every few months this is occurring in FLA.
If there is indeed state and federal laws to prohibit HoAs from harassing citizens it should be an easy dismissal for the veteran but he should counter sue for legal expenses and pain and suffering. These people have learned to use law are to threaten and hurt those they deem as the enemy regardless of whether or not their law suits are justified. Most people don’t have piles of cash to defend themselves against bogus claims.

Management company still gets paid from somewhere. Since HOAs are non profit, dues are the only way.
