Tesla Owner Files First-of-Its-Kind Lawsuit Over Vandalism Caught on Video

The lawsuit filed Tuesday by trial lawyers with Dallas-based Nachawati Law Group follows the weekend arrest of Rafael H. Hernandez by DFW International Airport police investigators. On March 16, the Tesla owner returned to the airport parking lot from a trip to discover a long, deep scratch on the side of his Tesla Model X. Mr. Hernandez was arrested after investigators retrieved the Tesla's onboard "sentry mode" security video that clearly showed a man using a car key to vandalize the vehicle.

"America is a free country, and you are entitled to purchase a car free from vandalism, harassment, harm or threats solely due to political beliefs," said Nachawati Law Group founder Majed Nachawati. "My client purchased a Tesla for reasons that have nothing to do with the things going on politically in this country. He enjoys his Tesla and believes it is among the best vehicles he has ever owned and is a great car to drive. To have someone persecuted for their choice of car is a travesty of justice. This is about freedom of choice and doing what you want, which you should be able to within the confines of the law."

The incident is part of a wave of vandalism and property damage targeting private owners of Tesla vehicles, who have been caught up in public anger in recent weeks conflating their vehicle ownership with support for Tesla CEO Elon Musk's work with the Trump administration's Department of Governmental Efficiency (DOGE). While U.S. Attorney Pam Bondi has threatened to aggressively prosecute the incidents, the Tarrant County lawsuit is the first known civil lawsuit filed by an individual Tesla owner related to the spike in vandalism.......

Sounds like Mr. Hernandez also needs some scrutiny by ICE.

Slippery slope just like Hate crime laws.
Vandalism is Vandalism but because its a Tesla they want to classify as "Hate Vandalism"?

Good. I hope the Tesla owner succeeds and is just the beginning of a wave of similar lawsuits.

I'd also like those running these Tesla Takedown events penalized as well for inciting intimidation, vandalism and destruction of Teslas and their owners.

Not necessarily. I can easily understand how being personally targeted because of the car you drive would cause the above.

Imagine not even being able to go grocery shopping without fearing coming back to a scratched up, dinged up, shat upon, spat upon, etc... car. That sucks.

These are pretty special circumstances, I get what you're saying... but people can't change cars like they change shoes. Cars are necessary to get people to and from work, school, appointments, grocery shopping, etc.. this intimidation, coordinated intimidation, is freaking terrorism.

it is hate vandalism. because dumbass liberals hate Elon, they are taking it out on people who own Tesla's. so the criminal should have to pay repair cost and also do jail time. 5 years should fit the crime. that will make the other idiots think twice.

If they're caught and found guilty, the court will order them to pay back restitution. Problem is that even if the suspect gets caught, its going to be at least several months before the court case is resolved and the restitution order is issued...if the perp pleads guilty. If they take it to trial, it may be a year or longer before its resolved. In the meantime, the Tesla owner is out of pocket for the repair cost or their insurance deductible.

5 years is going to be the minimum if the DOJ follows through on Pam Bondi's threat to charge these idiots with domestic terrorism. A bunch of assholes will be puckering when they get read an indictment for domestic terrorism charges that carry 5 year minimum sentence all the way up to life.

Breaking News: DC District Court Judge Boasburg has just thrown out the suit claiming discrimination as the main factor. Plaintiff ordered to pay court costs and slander damages to the Plaintiff in the amount of $100,000.

Why was the Tesla vandalized? Simply because it was the closest available car to vandalize and for no other reason? Or... specifically because it was a Tesla? Yes, this qualifies as "Hate Vandalism".

Tesla owners are terrified that agents of terror will vandalize, incenerate, shoot, or bomb them as they have done to many Tesla owners & dealerships. This is domestic terrorism, not simple vandalization.
