Why do Illegal Immigrants Get The Same Constitutional Rights As American Citizens?

Is it time to amend the Constitution? I think it's insane that people in the country illegally get the same rights as US Citizens do.

Because the Constitution says that they do.

Pretty straightforward, really.

If you don't like it, the Constitution provides a framework for its own amendment.

Illegal immigration to America is a relatively new phenomenon.

The founders never envisioned bordering a third world country with 130 million people.

If they knew that there would be a time in the future where people were crossing the border illegally, they would have written the constitution differently.

Are illegals "the people"? I say no; honest judges would too.
It is obvious that the 14th applied to slaves only. Otherwise, the "Indian Citizenship act of 1924" wouldn't have been necessary. The 14th didn't apply to illegal aleins!

Like it or not, he’s right that that’s how it’s been upheld. I learned that in1984 in PoliSci 101 - hopefully even before in high school.

The Constitution is a document of laws for American Citizens, it also outlines how to obtain citizenship. Unless I missed it, the older, more original parts of the constitution don't grant rights to illegal aliens, and the parts that do should all be challenged in court. The issue is that none of these are specifically outlined. They had this issue with illegal aliens in possession of a firearm.

Do you believe that it’s been properly tested in SC ? “ the people “ is pertaining to American people I would believe as if it was people in general that would consist of all people everywhere and I don’t believe that was meant nor could our constitution override another country’s rights.

Illegal immigrants do not get the same constitutional rights that Americans and legal immigrants do.

How does the government determine whether someone is here legally, or illegally, or is or is not a citizen, without some form of due process protection?

No, it is not. It is a document that outlines the procedures for operation of the United States government, places VERY strict limits upon the authority and powers granted to the federal government, and (in the Bill of Rights) outlines certain specific LIMITS on governmental powers.

Those LIMITS are what give rise to the "rights" that you reference (e.g, the right to counsel or the right to confront an accuser or the right to due process of law). EVERYONE is a beneficiary of those limits, whether a citizen or not.

There are certain things that the US government is simply NOT ALLOWED to do ... at all.

Sometimes it is a citizen who is the beneficiary of those limits, and sometimes the beneficiary is not a citizen. The limits are the same, either way.
