Imagine the complete freakout if he announced what Biden just did and the thread title was a headline.
It is seriously scary and depressing how all pretenses of covering this administration honestly have been thrown out the window.

I think this ratification was voted on by the states back in the 70s or something.

Yeah that's what the court battle is going to be over most likely. Some states ratified decades ago and Virginia was the last one needed to hit 3/4ths but they didn't ratify until just a few years ago. Also some states later rescinded their ratifications. This is very unlikely to survive, imo.

The Amendment was put forth in the 70s. Virginia ratified the amendment in 2020. Became the 38th state to do so.
But prior to Virginia ratifying it a few states’s ratifications have been withdrawn or timed out.
But there is nothing in the constitution about whether a state can put a timer on their ratification or withdraw it.
So basically this will go to the SCOTUS on those grounds.
On one hand: it makes perfect sense that you should be able to withdraw ratification before an amendment is ratified.
On the other hand: that’s not in the constitution. Some scholars argue that the founders didn’t want states to be able to go back on their decisions.
I think ultimately the Court would rule this hasn’t been amended. But it is not Biden amending the constitution unilaterally.

There currently is No 28th Amendment..
It's a position (#28) that is being fought for, by several different progressive backers. None of which have a snowballs chance in hell.
And neither does this. Because some of the backing for it, has been withdrawn.
However. If you look below the surface. Here's the dem strategy. To bring it up in court whether there is a deadline or time limit on a proposal to create a new constitutional amendment. Always keep in mind that the DNC plays The Long Game.
They are wanting to have a ruling that says something they push for now, can pass into law 50+ years from now.

States can withdraw their ratification votes before something becomes official. This was specifically brought up during our founding as some states said that if xyz wasn't done, they would withdraw their ratification and the others knew they were powerless to do anything about it.
