City of New Orleans, contractors sued by seven victims of 'preventable' Bourbon attack

I searched and didn’t see this posted yet.

Will be interesting to see how this plays out.

Seven victims of the New Year’s Day attack on Bourbon Street, including the family of a 43-year-old Terrytown man who was killed, sued the City of New Orleans and two of its contractors Thursday, alleging they each failed to protect the street from an assailant who easily got around the city’s security barriers before mowing down a crowd.
The suit, filed in Orleans Parish Civil District Court, was brought on behalf of victims Alexis Windham, Corian Evans, Jalen Lilly, Justin Brown, Shara Frison, Gregory Townsend and the family of Brandon Taylor, a local cook who died in the attack.
The suit names the City of New Orleans and two contractors — Mott MacDonald, LLC and Hard Rock Construction, LLC — who the plaintiffs say were responsible for drawing up the security plans for Bourbon Street and installing new barriers.
The suit largely takes aim at Mott MacDonald, alleging the firm failed to heed its own warnings to the city that Bourbon Street was vulnerable to a vehicle attack, the lawsuit alleges.

Pulled up their website.
I shite you not, the first thing that pops up is their motto:
"Toughness you can count on"

Nope. Nothing could have stopped this. It was going to happen had they set up the barricades or not. That is a lesson I learned from the lefties last week. There is also no way to prevent the next attack, unless of course it happens while Trump is president. Then it could have been prevented.
Just sharing what I've learned and have now accepted.

Of course. Because the City of New Orleans does not pay judgements, so they would have to get in line and hope some future administration 50 years from now pays it.

Billion dollar judgment leads to bankruptcy and bond defaults.

Many Louisiana cities and parishes ignore their judgements by hiding behind constitutional protection (can't lien public property).

Two things: I wonder who HRC is in bed with in the mayor's office aside from payouts to Latoya?
Second: how mad are all of these people that granny went and flat out admitted on TV that had they used the equipment they had, the guy wouldn't have been able to access the sidewalks.
Just frightening how blatantly corrupt and stupid these people are. Then I watch people defend them and I understand completely why these things happen.

Negligence is a nasty b*tch sometimes. If HRC or NOLA were negligent, so be it.

The government and police don’t have the responsibility to protect the public from intentional harm from criminal acts, right? Hasn’t this precedent been set already? Otherwise governments would be sued for every car accident, all property theft and damage, etc.
I don’t think the City will be held liable for this.
ETA: not a lawyer so who knows

I dont think they should be. This guy would have found people to run over regardless.
Lawsuits are the new "American dream" and people find its easy money. But we've lost all common sense in the meantime.

This Hard Rock is not the same as the hard rock that collapsed

I don’t think they should be, either.
I think families are grieving and want to hold someone responsible for these deaths, forgetting that the person who truly was responsible was killed by police. It’s just a really sad situation.

Here is an argument I expect for the lawsuit. The whole purpose of the work to replace the Bollards is for securing the streets they are installed. All the defendants know this and thus know that removing the existing barriers removed the security they were responsible for replacing. What they all should have done is left the existing security in place until the new security is operational. The fact that they removed the existing security without other viable temporary measures is where the liability comes in.

The only person that should be sued is the guy who ran people over
But he doesnt have deep pockets so you go after deep pockets

There’s one challenge to your notion that sticks out to me.
They apparently had hostile vehicle mitigation devices in their inventory and failed to deploy them.
Those, when placed appropriately, would have prevented him from getting that truck on the sidewalk where the main body of citizens were.
That’s a pretty big frick up.

I know. It's still just sort of the most New Orleans thing ever.
