boy thats a can of worms. The tricky part is not that its navigable, its what you can do on navigable waters. Unfortunately its not completely clear.

I don't know if he was trespassing, but I think he handled the confrontation appropriately. He is right, it's a damn shame that Louisiana can't or won't treat all navigable tidal waters the same!

It also appears that he either doesn't know how to or doesn't care to tag a fish properly!

Maybe we wouldn’t encounter this issue if we had hunters/fishermen with mutual respect for each other. Leave the waterways public and handle shite like men

Didn’t look like trespassing to me! frick all these “it’s private or leased” dick heads!! If it’s affected my natural tidal flow then it’s public!

Both of these are wrong in LA. If it wasn't a navigable water way in 1812, it's not public. Most times if you are polite, everything works out. Being a jerk or coming back when told to leave could get a trespassing charge.

Let’s just say someone in 1812 someone owns 1000 acres of marsh surrounded by water

It’s 2024 and now that actual land is 100 acres and 900 acres of open water

I still pay taxes on the whole 1000 acres

Let’s say a pipeline came through my marsh or they dug a trenasse through the middle of that remaining 100 acres

It’s now navigable for anyone but I still own that and pay taxes on it I don’t want anyone coming through tearing up my stuff

Also navigable does not mean you can fish/hunt there

And with the new equipment nowadays that can run anywhere (mud motors, airboats, etc) that further tear up what remaining land we have in the marsh I can see that side

There are certainly places that are 100% in the wrong for posting leather that is public. I would have to know exactly the situation here before I jump to conclusions

I inherited land down in Reggio. Prior to Katrina it was 75% marsh 25% water. The next day it was 80% water bottoms. People run crabbing boats, fishing boats and Kayaks. Technically I could post it in an attempt to keep people out. I don't and will not. I strongly believe if tidal waters cross it and it can be navigated it should be available to the public. Those fish, crabs and other wildlife are not mine. I certainly can understand duck hunters not wanting fishermen in their ponds during hunting season. This issue is out of hand and harming the people of the ability to enjoy are God given resources. The way it is going we will all be fishing the Hwy 11 bridge because everything else will be off limits.

I’ve fished gated marsh in dularge before.

Without having any physical gates at the entrances to these bayous i don’t know how a lane owner has any expectation of privacy.

Case in point went on a guided fishing trip last week to the ponderosa across from tidewater. I’m told this is private. What’s stopping everyone and their brother from fishing in there?

This is why BASS won’t have the classic in New Orleans again or allow anglers to fish the Louisiana side of the Sabine either.
It’s an archaic law that needs to be changed.
From my understanding, aren’t we the only gulf coast state with this law?
I grew up marsh fishing PAC and we absolutely stayed away from duck ponds but duck hunters didn’t want you remotely close lol
Anyway, why can’t we just respect one another in the water?!

I remember this from the Shumard case in E Carroll, 2005-ish. Put a kink in the high water hunt club membership.

How would you word the new law?

If I can float it I can navigate it? Hunt it? Fish it?

If I owned land that is now water, should I just give that up now?

What if that land comes back? Do I just sit idle and let it go to the state?

I don’t know this specific situation but if I was a duck hunter or fisherman that is leasing property and I saw someone on that property, I would be a little upset also. I am paying for that for my exclusive use

What if my family owned 1000 acres in Kenner in 1812 and it's been passed down for generations and now me and my siblings own it.

Now it's 1940's and there has been a decision to build an airport right along the edge of our property, should we sell or be ok with all the noise and traffic of the airport and keep it? Property valse will likely go down soon.

Sounds like a ridiculous comparison and in some sense, it is, but my point is times change, land use changes, and conditions always change. It sucks, but no one is forcing me/us to keep the land in Kenner if we don't like the situation.

I don't like that Weyerhaeuser recently clearcut the property adjacent to our camp, but land use changes, I have to deal with it or sell.

You make a good point Ron, and I see both sides too, but we can all agree the situation in Louisiana is long overdue to be addressed.

I think it was a trenasse off a bayou so man made Don’t know exactly where which is the rub. If he is in the natural bayou that’s one thing. In a man made trenasse that’s something else
