A Florida prosecutor is using the case of a man indicted for sex crimes involving children to test a new Florida law that allows child rapists to be executed. On Friday, State Attorney William Gladson said a grand jury had indicted Joseph Andrew Giampa on six counts of Sexual Battery Upon a Person Under Twelve Years of Age and three counts of Promoting a Sexual Performance by a Child, the office said in a statement on its website. “Given the severity of the crime and its impact on the community, the Fifth Judicial Circuit State Attorney’s Office has filed a notice that it intends to seek the death penalty,” the office said. The office explained the decision by saying, “The decision to pursue the highest penalty reflects the gravity of the charges and the State Attorney’s Office’s dedication to holding criminals accountable for their actions.”

Will probably be 10 years from now, which will also include a USSC ruling overturning their precedent in the matter.

As of this response, 7 downvotes simply for stating reality
Kennedy v. LA
That case literally involved the rape of a minor. The USSC said that the death penalty could not be used in a case without a victim's death. It's illegal to try to sentence a rapist to death.
Also, the rape in this case occurred in 1998, and the decision was in....2008. Like I said, it will take about 10 years to even have a chance for reversal.

This law definitely should be implemented here in Bama.

Will be overturned by judges that observe the rule of law.

In 2030-something.
Until then, it's illegal in the United States and he won't be executed anytime soon.

Probably is on the books but isn't enforced because it's illegal.
It's on the books in LA as a capitol offense, but no prosecutor is dumb enough to waste its parish's time and money on the virtue signaling.
First degree rape
quote:
C. For purposes of this Section, "person with a disability" means a person with a mental, physical, or developmental disability that substantially impairs the person's ability to provide adequately for his or her own care or protection.
D.(1) Whoever commits the crime of first degree rape shall be punished by life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence.
(2) However, if the victim was under the age of thirteen years, as provided by Paragraph (A)(4) of this Section:
(a) And if the district attorney seeks a capital verdict, the offender shall be punished by death or life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence, in accordance with the determination of the jury. The provisions of Code of Criminal Procedure Article 782 relative to cases in which punishment may be capital shall apply.

Potential slippery slope concerns me.
Sure, it'll be used in heinous, obvious cases.
But, eventually, could it be used in he said/she said? 20 years later, ex gf daughter makes up a tale?
We've seen justice system abused against Conservatives.
Just saying, it's a consideration.

That's no fun.
Let them have a guest appearance on "Air Jaws" while being towed off the back of a boat off the coast of South Africa.

Trump has been accused of this in civil claims, for instance

This will certainly be challenged but that's the point. Furman v Georgia stopped the death penalty entirely in '72 and then it was overturned. The point is to push back on the Left and not simply cede this stuff. It was certainly accepted that there were many crimes besides murder punishable by death for much of our history.
So in the end it's about what 5 people in robes decide. That's how the Left has played since Warren and we need to hit back.

Can't imagine life is very pleasant for a child rapist in prison. I think the death penalty might be the easier way out for them.

You are correct on the current state of the law.
But look at the vote composition of that case:
Majority
Kennedy, joined by Stevens, Souter, Ginsburg, Breyer
Dissent
Alito, joined by Roberts, Scalia, Thomas
With Kennedy and Ginsburg now off the court and replaced by Kavanaugh and Barrett, and with Roberts on the right side, they could overturn this case tomorrow if they chose.

So is raping a child. But that happened.
You sure do seem to take pride in being pro pedo.

Wrong. It was ruled that way by a past SCOTUS. That does not mean a future SCOTUS sees it that way. This is, after all, a matter of opinion, not a clear constitutional violation. See Roe v Wade for an example.
I’ll add that I think your predicted outcome is likely.
