Kennedy v. LA

That case literally involved the rape of a minor. The USSC said that the death penalty could not be used in a case without a victim's death. It's illegal to try to sentence a rapist to death.

Also, the rape in this case occurred in 1998, and the decision was in....2008. Like I said, it will take about 10 years to even have a chance for reversal.

Probably is on the books but isn't enforced because it's illegal.

It's on the books in LA as a capitol offense, but no prosecutor is dumb enough to waste its parish's time and money on the virtue signaling.

First degree rape

Potential slippery slope concerns me.

Sure, it'll be used in heinous, obvious cases.
But, eventually, could it be used in he said/she said? 20 years later, ex gf daughter makes up a tale?

We've seen justice system abused against Conservatives.

Just saying, it's a consideration.

This will certainly be challenged but that's the point. Furman v Georgia stopped the death penalty entirely in '72 and then it was overturned. The point is to push back on the Left and not simply cede this stuff. It was certainly accepted that there were many crimes besides murder punishable by death for much of our history.

So in the end it's about what 5 people in robes decide. That's how the Left has played since Warren and we need to hit back.

Can't imagine life is very pleasant for a child rapist in prison. I think the death penalty might be the easier way out for them.

You are correct on the current state of the law.

But look at the vote composition of that case:

Majority
Kennedy, joined by Stevens, Souter, Ginsburg, Breyer

Dissent
Alito, joined by Roberts, Scalia, Thomas

With Kennedy and Ginsburg now off the court and replaced by Kavanaugh and Barrett, and with Roberts on the right side, they could overturn this case tomorrow if they chose.

Wrong. It was ruled that way by a past SCOTUS. That does not mean a future SCOTUS sees it that way. This is, after all, a matter of opinion, not a clear constitutional violation. See Roe v Wade for an example.

I’ll add that I think your predicted outcome is likely.
