Kennedy v Lousiana was a 5-4 decision with a well argued dissent by Alito. It is highly possible that the USSC reverses that decision if it is heard again. Basis for a new hearing of that decision would be that this culprit, if found guilty, will have been found guilty of multiple acts indicating habitual, consistent, and incorrigible behavior. Execution for such an offense is neither cruel nor unusual punishment.
