In most prison systems, death (ultimately) after a long wait isn’t the punishment. The punishment is having spent that waiting period on Death Row, which is a very different living condition than gen pop.

That's a loaded question. To discuss this properly you're going to have to break that down into separate questions each with their own constitutional issue.
Like, for example, "protect illegal immigration". You have to define that specifically and give examples. Most of the issues at the border involve the Geneva Convention, which was a set of treaties legally agreed upon by Constitutional process. What is your Constitutional issue, exactly? Are you claiming that we didn't properly sign/ratify these treaties?
