Perp probably going to say you backed into her, and you are responsible for their damages. In addition to their “new” medical condition.

State Farm doesn’t want to pay your insurance back
Hopefully that works in OP's favor. They're messing with another insurance company and not a little guy.

Just call the spade a spade. Pussy

Threatening valid legal action is not extortion. You can say we can settle this for 50k or I’ll sue.
Correct.
He did not do that. He said "you have to do something to help me settle or I'll call the cops". You can't do that.

These dudes just said you going to the cops to report a crime that was committed is extortion.
Going to the cops to report a crime is fine.
Saying "do x or I'll go to the cops" is not fine.

Threat to Accuse of a Crime
A threat to accuse the individual threatened or any member of his family or any other person held dear to him of any crime. It is extortion if the defendant tells the victim that they will call the police and accuse them of breaking the law if the victim doesn’t pay him money or do something for him. It is illegal to get paid off to not turn someone in.

Like what kind of check? Damages are already covered.
Because, as I understand it, your wife can sue for up to a calendar year.
I would imagine that they are looking long term.

Something very similar happened to my wife a couple of years back. Rear ended at a stop light , driver took off. Car directly behind took a pic of the other vehicle’s plate. Local PD gave me insurance info on that vehicle, I called his insurance (progressive) and after about a week of back and forth they provided us with a rental and covered all damages. I did not notify my insurance (State Farm). Local PD never issued an arrest warrant for the driver though .

I’m shocked the other driver had insurance since they fled.

Yeah I can confirm that she's okay

Pretty much the exact thing happened to me. Not a hit and run. Police came for a info swap.
But USAA had to contact the other guy's insurance. He never called his insurance.
My insurance completed the ball rolling on repairs.
I got that same letter in the mail. They wouldn't cover. That should be FELONY FRAUD.
GET AN ACCIDENT POLICE REPORT.
Screw all the pieces of crap that don't play life the right way.
Your's was a hit and run?? That person needs beating. Pisses me off when I see that. Hope she gets in trouble for that, but she probobly won't.

Depends on where this happened. Statute of limitations in Louisiana for liability is a year, but it’s at least 2 years in almost every other state. IMO it’s one of the reasons our insurance rates are so high.

The perp's insurance doesn't want to pay. I hope your wife is ok.
Posted on 12/3/23 at 9:35 am to Shamoan
You have to be able to determine your wife is 100% ok before you do anything to release these claims. I got rear ended and found out within a week my shoulder had a torn labrum and a previous rotator cuff repair was ripped. Guess it's a first time for everything as the final bill for repairs and physical therapy was 240,000 not including my time and gas going to and from....Major pain in the arse.

How would the police prove this? Even if they gave a shite there's zero evidence.

But they're not saying "do this or I'll do that." They're saying "you choose."

You let your insurance debate with their insurance and provide I for if your insurance carrier needs it. Pass all correspondence to your insurance even if they already paid.

the car behind her (Cadillac) actually had a pic of the perpetrators tag from camera which was used in the police report and ultimately, to name the perp.
I’m confused as to what exact the issue is here. As you clearly stated above, the police used video evidence from the car behind the perp to identify both driver and vehicle. It’s in the accident report, which states the driver is at fault….
