Directly from the indictment...

"on the morning of January 6, the defendant and co-conspirators repeated knowingly false claims of election fraud to gathered supporters, falsely told them that the Vice-President had the authority to and might alter the election results, and directed them to the Capitol to obstruct the certification proceeding and exert pressure on the Vice President..."

They are absolutely indicting him because of J6 riots and they are using the riot as the "obstruction of and attempt to obstruct an official proceeding."

If they were only charging based on what Trump said to Pence or others, they would not include the above statements in the indictment as evidence that they plan to use the riots on J6 in the case.

You can stick to a narrow claim of no indictment "for" the riots but that is not being totally honest. Without the riots, we aren't even here discussing this.

Where? It’s not in the text you quoted.

And besides, let’s just say Pelosi takes the stand and admits to denying whatever security Trump allegedly requested. Explain to me how that bears on whether or not Trump “used” the riot?

Very point blanks is stating that the following list is the "manner and means" that the defendant (Trump) used in his conspiracy to "impair, obstruct, and defeat the federal government function"


below that are 5 sub paragraphs explains each "manner and means" used.

does not accuse him of starting the riot, cause the riot, stir up the riot, etc.
but the riot is specifically listed as one of the "manner and means" used by the defendant.

And none of them rely on or are based in Trump allegedly inciting, leading, or organizing the J6 fiasco. They are based in the other shite like the fake electors, etc.

If Trump can prove he was attempting to try to prevent the riot (through extra security, national guard, etc.) then it could theoretically cast doubt as to whether or not he was using it in his "manner and means".

because in a criminal trial, all you have to do is provide reasonable doubt.

showing efforts to prevent something can also be viewed as "reasonable doubt" to him also using it.
