I can kinda see both sides. Just from reading the snippet in the OP I thought the same thing...you can't C&D someone simply fo ra fleurdelist that's ludicrous.
But looking at the picture, the fleurdelis is placed on the side of a skull that at first glance can certainly resemble a helmet, and the whole thing is black and gold. I can sort see their point.
Would I waste my time with this foolishness? No. But I can at least see where they're coming from with it.

I know people here like to shite on the city, and I wouldn’t cross the parish line if I didn’t have to, but I think the city with its port is pretty meaningful…. And NO is recognized around the world, if you ask people around the world where Baton Rouge was, I bet they wouldn’t know.
A major music culture was born in NO…

I was all ready to smash the NFL but the particular style of fdl, combined with the location on the head, combined with the black & gold coloring scheme, sure looks like a Saints helmet to me. It's not any one thing but the whole scheme together.

The black and gold is the big issue.
the FDL isn't the property of the NFL, but the FDL in conjunction with black and gold may be.
Kind of like how gas stations have to toe the line on using purple and gold and "tigers" to name their station. They can usually get away with one variable but not both.

I'm no IP expert but one of the forms of IP requires the owner to do just this or they risk losing it.

I would think letting Defend New Orleans operate for 20 years before the letter has to be considered.
