Amused at how so many believe a 6 year old was just biding his time until the unknown day he’d be unsupervised so he could strike, and even fool teachers leading up to the process.

No 6 year old planned that.

Most states have a carve out for gross negligence. If gross negligence is found, the exclusive remedy of WC is no longer exclusive. A civil suit can be filed.

principal, school administrators- fired, possibly criminally charged and fair game for lawsuits.

Gross negligence is a very high bar to to exceed.

Hopefully lawsuits like this force schools to stop the practice of "equitable discipline." Just because a kid is a minority doesn't mean you can let him/her get away with murder.

It sounds like every adult at the school was terrified to search his backpack, even after multiple sightings of the gun, for fear of being called a you-know-what, disciplined, possibly fired, and cancelled. They didn’t expel him even after all the previous incidents. Imagine the bizarro world of working at that school where everyone is terrified of that little kid. Reminds me of a Twilight Zone episode where this kid could turn people into toys so the whole town catered to him.

Based on the accounts of the story, I would think they breached that level by quite a bit.

The disciplinary records of the kid in question, the witnesses that affirm the teacher relayed fears about the gun to the principal and got blown off, etc, show that the school abdicated its responsibilities to a “safe learning environment.”
