There is a very strong chance your property has been surveyed and staked. Get a metal detector and find your corner stakes. Run a string from stake to stake to determine your property line. They are usually 3/4" rebar driven down about 6 inches.

I just dont think I would worry about any of it. I would be so glad the broke down fence is replaced.

I'm just saying I wouldn't allow my neighbor to just freely adjust my current fence unless there is definitive proof that the fence is over their property line.Right, that's ballsy. Even for the fence guys.

Do you know that he has not gotten a survey, or that he has found the property corners and knows that your fence is on his side???

but again, go over and talk to him , express your concerns and see what comes up, probably a big deal about nothing that a nice conversation and a six pack can not settle

Talked to him, he had no idea… no survey. Waiting on the fence guy to see what he said. He was not cool with them messing with my fence and grinding the brackets option etc. I said I think they miscalculated their line, he didn’t say much. I said well we’ll see what they say. I offered to compromise that he could get them to dig a new post hole on my side and reposition my post with brackets approx 6-12 inches and saw off the very end of my horizontal posts or he can just build around my fence or redig his post holes to change the line

I agree. I had our lot surveyed a couple years ago, and what I thought was our property line wasn’t. Our lot isn’t perfectly perpendicular to the road (slight angle), but who ever built our wood fence and driveway “squared” it up to the road. So a sliver of our fence on both sides actually is on the neighbors property. The surveyor said that is extremely common.

I wouldn’t get in a pissing match because if you get a survey, there’s a good chance you might be encroaching on his property

I’ve calmed down, life is too short. We won’t stay here forever. I just told him don’t want them defacing our fence to make his fit. Just seems pretty stupid, if no one knows the actual property boundary, why wouldn’t you make sure the line matches the 2 points already there. Oh well, life goes on.

Decided to compromise and be the bigger person…let them remove one board and they will just replace our bracket and put a more narrow support on post. They will have to saw off an inch or 2 of the horizontal beams poking out. The fence guy gave the option of having my beams stick through his fence but I said no, might as well look good.
Fence won’t tie in and they will place another narrow board in front to enclose post.

Only other option was saying you can’t touch the fence until we get a survey and then cause permament resentments with the neighbor. I can always get a survey later if I want and see where line actually is

Get it in writing that they admit they put it on your property and it’s not on the line, and don’t claim the extra 6”. It could be an issue when you go to sell.

$500 for a survey is way cheaper than lawyers

I’d have done the same thing, it wouldn’t have elicited a visceral reaction from me. But like, dude, you don’t just get to park in my driveway. Should’ve known better. It’s common decency.

Granted this was years/two houses ago but when we put a fence up, we couldn't find all the metal markers from the survey we did three years prior so the fence company required us to do another survey before they would install anything. We weren't tying into another fence but we did have an asshat behind us claiming part of our yard was his (we suspect that he dug up the metal marker as that was the corner we could not find). Bonus was that what we thought was part of another neighbor's yard was actually ours too so we were able to cut down some dying trees they refused to take care of and have a larger fenced in yard.

Even if this issue is resolved, wouldn't be a bad idea to get a survey so in the future everyone is working with facts and not assumptions and emotions.
