Fred's has some trash that goes there but they're better at keeping guys like these rapists out.
The drinking is no less there though. The bartenders are all drunk and it's anything goes in there. I mean there's a video of their motto 'we do the fricking' promoting that their bar is a modern animal house

She was 19. There's no way to spin this. It starts with a 1 and then follows w/ a 9. That makes 19.

I'd like to see that fricker who owns the place in jail. How many times can you get hand rapped for underage drinking? He's a fricking scourge who deserves whatever bureaucratic hell anyone in power can throw at him.
Let not pretend these kids don’t have fake ids or don’t just have someone buy it for them. It’s not exactly difficult to get around the 21 laws.

let me preface this with saying that what happened to this girl is horrible and all should be prosecuted to the full extent of the law. With that being said here is my question. .... 3rd degree rape occurs when a person knew or should have known that the victim was incompacitated and not in a position to give consent. Does the person committing the act have a defense if he too is incompacitated and therefore is not able to know or should know the victim was unable to give consent? are there any criminal defense attorneys in here who can provide the answer?
I asked this same question and you’d thought I’d slapped some posters moms in this thread.
It’s a legitimate relevant question … regardless how bad it’s hurts your feelings.

If only there were statements made by the perps...

4 months later makes 20….that makes Almost 20. You really are an insufferable douche. And that is also a fact

I don't know the law in Louisiana. I do know in Texas.
In the scenario you described, in Texas, the male has raped the female. Even if a drunk female initiates sex with a dunk male, the male has raped the female.

don't get pissy cause you're trying to make a point how close 19.66 is to 21 and minimizing the underage part of the story. Same story with 2 18 yr olds and a 17 yr old getting served in the bar as well.

why are kids under 21 allowed in these bars? Is that a Louisiana thing?
you can get into bars underage, if you don't have a fake ID they will mark your hand with x and bouncers will take drinks from your hand from time to time (like once a week).
It is my understanding that fake IDs now are way better than they were back in the day. We use to print out the temp texas paper ID
8 dude rolling into bars with these things

The owners are never present in bars like these. They usually have a post college aged manager but even that guy can't be there 7 nights a week. The operation of the place has been in place for decades. It's honestly surprising disasters like this haven't happened more often
I’d guess that it does and the only reason we know about this is because she got hit by a car.

I think you have to be 45 days away to be almost something. Final verdict

I anticipate that it won't be well received but I would think everyone would want to know. if these scumbags get off on something like this it will be awful, but who wants this defense (if even viable) to first come up at trial.

Why even the need for fake ID's.... look bitch, i'm 19.7 yrs old!!

It’s a stupid arse question. Read the facts of the case again, doesn’t matter if they had a few drinks. FOUR people videoed themselves laughing at having raped her because she could hardly talk and dumped her on the side of the road

I made the point earlier that the white boy in the car was 18 years old and may not have understood that he could still be held liable, even though he didn’t participate in the actual rape. I said that 18 year old brains haven’t fully formed, and they are still learning.
So, my next point might be viewed by some as somewhat hypocritical or inconsistent.
I keep seeing people manifest all the faux self-righteous indignation they can muster, damning underage drinking.
Maybe I’m jaded because when I was in college the drinking age was 18. And, for me, I actually learned how to drink and handle myself while drinking during college. It was part of my college experience.
Further, raising the drinking age to 21 was forced on Louisiana by the feds thanks to the actions of a bunch of insane women collectively called MADD. I’ve never been in favor of a 21 year old drinking age. If you’re old enough to sign up for the draft, join the army, and go all around the world and get shot in the name of your country, then you should be old enough to drink. Therefore, I’m just not buying all of these self righteous a$$holes who are acting like underage drinking or giving alcohol to a 19-20 year college student is a sin warranting time at Angola.

Ignorance of the law is not a defense. This is basic stuff

This thread is full of people making accusations regarding things they're clearly not in the know about so they can pin blame on someone who's not to blame.
Rage over underage drinking is a very recent thing. Throughout history, teens drinking has been relatively normalized.
Most Karens here wouldn't have survived the 70s or early 80s.

They are not getting off but if for some crazy way they did they have to run for their entire lives.
