I keep hearing the leaker is in deep trouble. What’s the liability for Politico leaking it

I never heard anyone yet blame politico for leaking the news?

I hate Politico but the government cannot go after the media. First Amendment protects them. They broke no laws publishing it.

Im not sure its exactly illegal to leak a Supreme Court draft

Then again the Supreme Court can make it illegal

They broke no law because the court previously held under 1970s case law there is no reason for a publication ban on leaked material.

But if we are revisiting 50+ year old cases here that one may come up soon too.

Nothing really can be done criminally about leaking the document, however when he or she lies or there is evidence they tried to cover their tracks then deep shite for that person.

These opinions that are always shared through the court have strict rules about how they are distributed.

Someone deep in the Supreme Court leaked this.

This wasn't an accident.

The supreme court can make it illegal

They can retroactively make it illegal

They can basically do whatever they want

The Pentagon Papers case from the Nixon era held that the NYT couldn’t be held liable for publishing the papers even though Daniel Ellsberg was not authorized to distribute them.

They also held that the government couldn’t put prior restraint on the NYT to prevent them from publishing them.

I didn’t say they should. The person I replied to said they can’t. The federal govt can do whatever it wants, if this isn’t clear to someone after the last 100+ years then it won’t ever be until it is their rights that are directly violated.
