I know the story has already been posted but some new information came out. It looks like the family is opening a law suit and has employees saying they have been reporting the broken freezer for 9 months.

Citing information from a former Arby’s employee whose identity was withheld, Le’s children allege the latch to the door of the walk-in freezer had been broken since at least August last year. Employees were using a screwdriver to help open and close the door, the suit says, adding that workers also used an oil box to keep the door open. Staff reported the broken door to local management as well as Le’s supervisor in Houston, the suit says. The former employee described personally showing the broken freezer door to the supervisor.

I wonder if some of the employees were negligent as well or outright hostile to the manager. It seems hard to believe that she couldn't have found something metal to bang on the door and make enough noise for them to hear. Anyone know how Arby's are set up? Is the freezer far enough away from other parts of the store to make hearing someone an issue?

Is there an email of this? Because if it’s just he said/she said then that holds no weight.

How does this not fall under worker's comp. Meaning this is a 75K case if she doesn't have any dependents.
Unless they can find fault against the manufacturer of the freezer potentially.
Are there logs on the equipment...if not what the employees are saying isn't worth shite from Shinola.

It’s like these workers never watched MacGyver growing up.

If there is evidence of reports of broken equipment that wasnt' handled by the company...sure.
If there is no evidence of any inspection logs of equipment...maybe could go either way from what I hear.
Only thing I've heard so far is employee's talking about the door being broken....if that's all they have to prove "gross negligence"...well I hope the family is happy with 75K to split amongst them all.

Nguyet Le, 63, worked as an Arby’s general manager and was opening the eatery in New Iberia, La., about 30 minutes south of Lafayette, when she somehow became stuck inside the freezer on May 11 “and beat her hands bloody trying to escape or get someone’s attention,”
She’s the damn GM. The broken freezer not being repaired is on her.
That doesn’t mean the franchise wont settle.

If they were smart they would probably settle unless they have good records that the equipment was inspected and marked good for every period in recent history and have no legit record of a complaint being made about the equipment being broken and not fixed prior to this incident.

They would only settle to make it go away. She wasn’t a shift manager she was the GM. GMs are responsible for everything that goes on under that roof. (It’s why GMs are often named in lawsuits as a defendant)
In this case the GM would be responsible for reporting and making sure that repairs are completed and the building is safe for employees and customers.
The only defense is if she continually reported it to the franchise owner and the franchise owner continued to kick the cam down the road.

Time to boycott unless you guys support companies who murder employees by refrigeration.

The news cast I saw this morning said that multiple work orders had been submitted up the chain of command. The way they worded the report made it sound like there was a paper trail of the request.
