Dak has the right to own dogs and whatever breed he wants. However, he takes on the added risk just like any home owner does. He/or his insurance company will settle this and she will get paid. When you have homeowners they ask if you have dogs and the rate increases for certain breed of dogs. The ins company and Dak takes the risk. He will prolly have to fight the court to get his dogs back. Its just a bad situation all around.
