They certainly do. However an impaired driver shouldn’t even be on the road. By driving at a .08 he is breaking the law. Therefore just his presence on the road is a contributing factor.

The statute for vehicular homicide is 14:32. It says that if impairment was a contributing factor to the crash, the person should be charged. Impairment will always be viewed as a contributing factor to the crash. There are loads and loads of data and research that shows alcohol (a depressant) slows reaction times. Was his impairment the cause of the crash? No. But was it a contributing factor? Yes. Therefore it meets the criteria for 14:32.
Why did the cops go through his phone? I'm sure he agreed to it but I'm still confused what would be the consequences if he was videoing some lady changing a diaper in public.

In Louisiana, if you refuse the breathalyzer a search warrant will be drafted and submitted to a judge for a sample of your blood. Either way, the officer is getting the evidence.

If you refuse, your license will be suspended for a year automatically. no matter if you're found guilty or not. You still refused the breathalyzer so your license will be suspended. This is because of the implied consent law (when you sign your name on your driver's license you are agreeing to consent to chemical tests when asked to do so by a police officer). If you take the test and blow over a .08, your license will be suspended for only 90 days. the penalties increase as your BAC rises.
