I think it's a federal case if involving allegation of violation of federal election law. So if they continue to stand behind the OLC memo then they're out of luck unless they can demonstrate a violation date of after January 2015. Certainly out of luck if Trump wins again in 2020.

Well NY wouldn't be prosecuting a Federal Election crime, but the fact pattern intertwines with potential state crimes, so they were holding back.

Reports have indicated that they are looking at potential state tax and banking fraud violations. This is why the grand jury requested Trump's taxes.

The U.S. Atty for SDNY would be the prosecutor on a federal election law violation allegedly occurring in that district, which is where the supposed meeting with Natty Enquirer chief occurred.

But as for any parallel type state charges, would be separate peosecution by Manhattan DA or maybe NY state AG.

Right, this is exactly what's happening right now. They not prosecuting the conduct directly with the payoff, but the indirect actions, like covering up the payoff by falsifying documents.

Why do you want Cohen to do more time in prison? Have some empathy, dang it. If Trump told him to do it LEGALLY and documents were falsified, who do you think that falls on?
