re: Why wouldn’t Trump’s attorneys say the documents are declassified while Trump says it?

I’m still trying to understand how a president, who can unilaterally declassify anything by merely handing a document to someone or allowing someone to remain present while classified information is discussed, can ever run afoul of any rules regarding classified information.

You ain't married until you file a marriage certificate, and documents aren't declassified until they're stamped declassified.

Even if the documents were 100% declassified, Trump is not legally allowed to be in possession of them. Worse, he was found in possession of those documents after he had an attorney swear that he had returned all GOVERNMENT (not classified, GOVERNMENT) documents.

It’s getting harder and harder to make a compelling argument for your side isn’t it?

That has been the crux of my argument from the beginning of all of this. It's been amateur hour and a bad one at that. Trump has put his attorneys in almost impossible positions. If I had DOJ breathing down my neck I would want to be sure that I'm not giving them easy shots at my client.

I suspect it's because he has not been straight with his attorneys. He cannot present a paper trail.

If anything, this Memo is damning to Trump. It clearly demonstrates that Trump KNEW how to PROPERLY declassify documents and that he did NOT do so regarding the bulk of the material that he removed from the White House and took to Mar-a-Lago.

I agree. There were a couple of instances where Trump claimed to have declassified things then had to go to court to claim that he actually did not do it.

So, essentially, with the DOJ attorneys sitting right next to them, they said, "if you want to know which documents are declassified, then indict our client."

This makes sense. Thanks!!

Not true for TS/SCI and if there is an SAP slapped on it.there are procedures the Presidents follow. Someone showed a momorandum on Crossfire Hurricane....okay...but what if that's not the bone of contention?

Besides if he declassified Crossfire Hurricane, why not make them available for release and shut people up once and for all on the Russian thing? Why play these childish games?

For the last time...the president has no procedure to properly declassify documents.

As smart as you claim to be, you should know this.

That's a fricked up way to approach it if you are in the right.

It’s not even that they won’t present a paper trail, because IMO reasonable minds can disagree on whether POTUS needs a paper trail in that instance.

But he hasn’t even presented the assertion that the docs were declassified at all. I cannot reconcile that they haven’t done so. I would have that representation featured prominently in everything I filed in this case and in every statement to the press, if I believed it true. It’s hard to imagine a strategy where not doing so helps Trump.

Remind me if you ever become an attorney not to retain your services.

The objective is to keep your client away from USA's and the like....not to keep tweaking them for selfish enjoymeny

Maybe it's so cut and dry he doesn't have to do so.

You know...Plenary powers.

Actually, that isn't true. You're married when you state your vows. Filing of the marriage certificate only puts the public on notice of the marriage. Just sayin
