Another great question "Why doesn't OSHA mandate ANY other vaccines"
Posted on 1/7/22 at 10:53 am to Lsut81
Gorsuch destroyed her.
I am really confident in 3 votes each way.
Gorsuch, Thomas and Alito are going to vote against mandate.
I THINK Kav might.
At that point it is up to either Roberts or Barrett to side with them.

At the end of the day, you can take a hard hat off and go home. You can't remove a vaccine. That is where OSHA crosses a line

She just said, "Well those are effective vaccines" referring to the polio
Posted on 1/7/22 at 10:55 am to Fun Bunch
All workers are typically vaccinated (against other illnesses). This is bullshite. Most vaccines last, at max, 12 years. Most workers are actually unvaccinated for most illnesses by the time they are an adult.

I like that Roberts questioned her about the fact that they specifically said they were using OSHA as a "work around"...at least gives me hope that he sees that they are playing games instead of trying to use Congress to pass a mandate since they know it would fail.

Sounds to me like Roberts may vote against. His stance seems to be pro-vaccine but not in OSHA's power without approval of Congress.

They're going to decide this today, right?
Posted on 1/7/22 at 10:57 am to Landmass
Right. There is only 1 vaccine that I am aware of that is a lifetime vaccine.
All of the others are not. Some are a long time, but not lifetime.
The polio vaccine for instance is not a lifelong vaccine.

I'm feeling slightly optimistic that were going to get a stay out of this.
I would have said no way after the first round of questions, but the AG of Missouri and then this shite show, its looking positive.

How does this work after arguments? Do the judges go to a room to discuss like a jury? Do they each advocated for others to join them by persuasion?

HIGHLY unlikely.
They will try by Sunday though.

They may or may not issue a stay today. The ruling will come later, I'm sure.

Mandating that employers with over 100 employees require vaccines or testing of its employees is a violation of 14th Amendment’s Equal Protection Clause because it doesn’t apply to employees working at companies with 100 or less employees.
The creation of an OSHA standard to force companies with >100 employees to comply with mandates will define workplace exposure to COVID-19 resulting in illness as a work-related illness and will result in workman’s comp claims and lawsuits.
For a company like Walmart whose employees will be compelled to abide by the mandates, what about the millions of customers that enter Walmart stores each day? Shouldn’t the Walmart employees be afforded the same “protection” from unvaccinated customers entering its stores? By not requiring that customers be vaccinated or have a negative test result, would Walmart not be guilty of creating a “workplace hazard” for its employees?

yep. oops!
good questions being asked --- not sure I like the arguments the government/OSHA's attorney is trying to make. Was curious if they would have some strong precedents but their case seems thin other than "OSHA" gets to interpret what they feel is dangerous and do what they want
This is a great chance to reign in the power of these governmental agencies -- wonder what they'll do. Pretty big fricking day here

You’re assuming one of Kavanaugh, Gorsuch, Barrett, Alito, Thomas are for the mandate. Wouldn’t be surprised if that happens, but we already know what Roberts will do, so his name is not even worth mentioning.

If Roberts votes against there's no way it passes.
I don't see both ACB and Kav voting for if Roberts is against.
And Gor, Thomas and Alito are 100% against.

Or could issue an administrative stay so they have a few more days to decide whether an actual stay happens.
