However, OSHA is taking the position (as Kagan suggests) that this is a policy decision it made. PERIOD. And, the plaintiffs should have the opportunity to challenge that policy decision. And, the only way to protect workers until that policy decision can be challenged is to issue a stay -- which is what the plaintiffs are asking for here.

Correct. And the legal issue at play is whether they had the authority to do so (ie whether OSHA’s authority extends to this type of general harm that is not inherent to the workplace or the work being done).

That depends on whether OSHA is acting outside of the parameters of its enacting legislation. Like I already said.
The merits of the policy determination will never ever be before the court. The Court has no authority to interfere with policy determinations made within an executive agencies lawful parameters granted by Congress.
It is about OSHA’s/the administrations authority to make this policy decision relating to a general harm.
