It is about OSHA's authority to carry out directives pursuant to that policy determination. There is a difference.

A policy determination was made. According to Kagan, it was OSHA and its "experts" who made that policy decision. Now, we all KNOW that that is a bunch of complete f*cking bullsh!t and that OSHA was simply following the orders of Raping Joe so that he could do this "work around."

However, OSHA is taking the position (as Kagan suggests) that this is a policy decision it made. PERIOD. And, the plaintiffs should have the opportunity to challenge that policy decision. And, the only way to protect workers until that policy decision can be challenged is to issue a stay -- which is what the plaintiffs are asking for here.

Bro, you guys are going to be looking for jobs with companies with less than 100 people or becoming your own boss and starting a company. Or end up on unemployment.

This is over, sadly.

Im assuming you were being sarcastic. You were suggesting Hitler level response to anti vaxed. Thats a huge gamble for an armed populace. Would hope we can solve this peaceably but that would be korean roof level IMO

If you are vaccinated where is the grave danger?

Why force the others?

I don’t know where us “purebloods” are going to go? Every company or job will have these mandates in force. Unless you start your own business.

I believe if you can work remotely you don’t have to take the shot, right?

Already being done. This was all a smoke show to let businesses blame it on OSHA. Can't put the toothpaste back in the tube.

Correct. And the legal issue at play is whether they had the authority to do so (ie whether OSHA’s authority extends to this type of general harm that is not inherent to the workplace or the work being done).

quote:

the plaintiffs should have the opportunity to challenge that policy decision.

That depends on whether OSHA is acting outside of the parameters of its enacting legislation. Like I already said.

The merits of the policy determination will never ever be before the court. The Court has no authority to interfere with policy determinations made within an executive agencies lawful parameters granted by Congress.

It is about OSHA’s/the administrations authority to make this policy decision relating to a general harm.

The vaccine is a fricking theraputic at best. You can’t force people to take a medicine. Can’t make people take Motrin. Shouldn’t force them to take the “shot”.

No no no no no.... Osha said they won't enforce if showing good will.

Do not leave this up to OSHA. Stay it. People are quiting because you are requiring them to submit vax status
